Inc., Intervenors, as representatives of the residents of South
Hutchinson Island hereby represents that the goals of the
153.53(2) petitions organized by the Presidents' Council, were
the same goals sought to be accomplished pursuant to the now
ongoing MSTU procedure.
5. The parties acknowledge and agree that it is in the
best interest of the citizens of St. Lucie County and the
residents of South Hutchinson Island that the MSTU proceed as

scheduled. They further agreed that the creation of the MSTU ;

will render moot the creation of a 153.53(2) special taxing f
district.
6. ~here is at this time an appeal pending, case number
89-0117, from the final judgment of the court, filed by the
Board of County Commissioners of St. Lucie County, Florida.
7. It is now the desire oi the parties hereto to resolve
the pending issues relative to the above appeal. With that in ~
mind the parties agree as follows.
i A,. The appellate case number 89-0117 shall be

~ dismissed by the plaintiff.

~ B. Upon revesting of jurisdiction in the circuit
i
~ court of St. Lucie County this stipulation shall be
filed in case number 88-8-CA-17.

~ C. The parties mutually agree that the final judgment
~
~ dated December 13, 1988 shall remain in full force and
~ effect with the exception of the provisions of the
~ ordered paragraph 3 requiring that the 153.53(2)
~ election praceed.
~ D. The intervenors agree that they will take no
~
actions of any type to seek the establishment of a
153.53(2) special taxing district for a period of at
least one year and wi11 further not do so during the
z time that a MSTU is pending.

~ E. For the purpose of preserving and establishing the
~ records of the defendants, the petitioners shall seek
~
~
and obtain a sufficient number of signatures from
