HomeMy WebLinkAbout1112 r I 1 ~ Premises under Subleases entered into subsequent to the date hereof provided the rentals payable pursuant to said subleases are at no less than the then current market rate and all other terms of said subleases are reasonably acceptable to Mortgaqee in the light of the then current market. 31. Failure to Consent. If Mortgagor shall seek the approval by or the consent of Mortgagee hereunder or under the Note, and Mortgagee shall fail or refuse to give such consent or approval, Mortgagor shall not be entitled to any damages for any withholding or delay of such approval or consent by Mortgagee it being intended ~ that Mortgagor's sole remedy shall be to bring an action for an ~ j injunction or specific performance which remedy of injunction or I specific performance shall be available only in those cases where ~ ~ ~ Mortgagee has expressly agreed hereunder ar under the Note not to ~ ~ unreasonably withhold or delay its consent or approval. ~ 32. Mortgagor hereby acknowledges receipt of a true copy of f ~ this Mortgage. i i 33.
