The Parties have read this Agreement and have had its terms and consequences explained to them by their respective counsel and they believe and acknowledge this Agreement to be fair, just, and reasonable. Each of the Parties is acting without coercion or duress, and freely and voluntarily assents to its terms and accepts its conditions, obligations, and mutual agreements. BEPgESENTATIOH BY OOIINSEL 2. During the negotiation, draf ting and execution of this Agreement, the Husband has been represented by Kevin H. Hendrickson of Phillips ~~a1e, P.A.. The Wife has been advised that Kevin H. Hendrickson of Phillips S Gale, P.A. does not and can not represent her and has further i been advised to retain independant counsel. The Wife has been represented ~ by L. Lisa Batts, Esquire during the negotiation, drafting, and execution ` of this Agreement. ~ ~ PEZIDIN6 ACTION FOB DISSOLiTTION ~ 3. The Parties have filed an action to dissolve their marriage in ~ the Circuit Court of the Nineteenth Judicial Circuit in and for St. Lucie , County, Florida. This Agreement is intended to be a full and complete ~ settlement of all matters arising or which would have been brought in that ; action, including a division of marital assets and tlne care and support of the Parties' minor children. This Agreement fs intended to be introduced into evidence in that dissolution of marriage action, and to be incorporated into the Final Judgment of Dissolution of Marriage. However, the Parties do not intend for it to be merged in the Final Judgment. Rather, they wish it to survive the Judgment and be binding of the Parties for all time. EFFEGTIYE DATE 4. The effective date of this Agreement is the ~I~ day of ~C~L~r'~L~.Q.~` ~--1 ~ 1990 . SEPEBATION AND I~IONI~FEBENCE 5. At all times after the execution of this Agreement during the pendency of dissolution proceedings, the Husband and the 41ife shall be entitied to live seperate and apart from each other, and each sha11 be free from any interference, authority, and control, whether direct or indirect, by the other Party to the same extent as if they were unmarried. E3ch Party recognizes the right of the other tQ select his or her place of abode, and the right to live with another person if he ar she should so choose. Each Party has the right to conduct any trade, business or employ~ent.
