FUTURE ADVANCE A~~tEEMENT

This Agreement, made effective as of the ay of
January, 199Q, by and between DANIEL K. DEIGHAN, a single man,
the ("Mortgagor"), and BARNETT BANK OF MARTIN COUNTY, N.A. (the
"Mortgagee").

A. Mortgagor is indebted to Mortgagee under that certain
promissory note dated December 13, 1985, eaecuted by Mortgag~r
in favor ef Mortgagee in the original principal amount of
' $480,000.00 (the "Note," which term included any modifications,
renewals, extensions or alterations thereof), which is secured
by that certain mortgage and security agreement dated December
13, 1985, from Mortgagor to Mortgagee, recorded December 20,
1985, in Official Records Book 486, page 618, St. Lucie County,

Florida, public records (the "Mortgage," which term includes
any modifications, revisions or amendments thereof),
I encumbering the real and personal property described therein.
~ B. The mortgage has been previously modi€ied by:~ a

E Future Advance Agreement dated May 26, 1989, recorded June 2,

~ 1989, in Official Records Book 00639, Page 2253, St. Lucie
~ County, Florida public records.
~ C. The Mortgagor has requested future advance under the
Mortgage in the amount of FORTY THOUSAND AND NO/100 DOLLARS
~ ($40,000.00), and the Mortgagee, at its ~ole option, wishes to

~ make the future advance in such amount to Mortgagor under the
~ Mortgage.

TERMS
THEREFORE, in consideration of the mutual covenants
contained herein, the Mortgagor and the Mortgagee agree as
