Duda & Sons, ' Inc., as "Grantor", and D~ M Indian River Groves, as "Grantee", dated September 18, 1985 and recorded September ; 20, 1985 in Official Records Book 477, Page 437, Public Records of St. Lucie County, Florida, as modif~ed, in part, by termination and cancellation of the non-exclusive easements and rights granted in Paraqraphs 4 and 5 of said Easement Agreement, which cancellation was effected by the recordation of that certain Affidavit Concerninq Termination of Easement Rights recorded in Official Records Book 628, Page 1576, Public Records of St. Lucie County, Florida. 3. That certain I-95 Joint Use and Maintenance Agreement dated ' September 18, 1985 and recorded September 20, 1985 in ~ Official Records Book 477, Page 453, Public Records of St. Lucie County, Florida. 4. Reservations in favor of the Board of Education of the State of Florida contained in that certain Deed from the Board of Education of the State of Florida to 0. L. Peacock and Mildred Vare Peacock, his wife, dated June 18, 1951, filed June 21, 1951 and recorded in Deed Book 165, Paqe 99, as to all of Section 16, Township 37 South, Range 39 East, as to an undivided three-fourths interest in and title in and to all phosphate, minerals and metals and an undivided one-half interest in and title in and to all petroleum with the _ privilege to mine and develop the same; also reserving the right to enter upon said lands and make or cause to be made and constructed thereon such canals, cuts, sluice-ways, dikes and other works as may, in the judgment of the Board of Education, their successors or assigns, be necessary and needful for drainage or reclamation, etc. ; ; 5. That certain Right of Way Agreement dated December 10, 1957, filed December 19, 1957 and recorded in Deed Boak 234, Page 102, from O. L. Peacock and Mildred Vare Peacock, his wife, Ida May Peacock and 0. L. Peacock, to Florida Power and Light Company, a Florida corporation, as follows: A right-of-way 110 feet in width in Sections 26, 35 and the West 1/2 of Section 23 (excepting public road and canal r/o/w), Township 37 South, Range 39 East.
