DRAINAGE AND IRRIGATION EASEMENT '
THIS D IN GE AND IRRIGATION EASEMENT ("Easement") is '
made as of theo~~~ay of January, 1990, by A. DUDA~~& SONS~„
INC., a Florida corporation (hereinafter called the Grantor
to HORIZONS ST. LUCIE GROVES ASSOCIATES, a Florida general
partnership, whose post office address is 1645 Palm Beach Lakes
Boulevard, Suite 480, West Palm Beach, Florida 33401 (hereinafter
called the "Grantee"):

` and "Grantee" include all the parties to this
instrument and their assigns and successors-
in-interest and title).

i W I T N E S S E T H:
' WHEREAS, Grantor is the fee simple owner of that
e certain real property located in St. Lucie County, State of
' Florida, commonly referred to as the O. L. Peacock Canal and more
~ particularly described on Exhibit "A", attached hereto and made a
~ part hereof ("Servient Estate"); and
~ WHEREAS, Grantee is the fee simple owner of that
! certain real property located in St. Lucie County, State of
~ Florida, and more particularly described on Exhibit "B", attached
` hereto and made a part hereof ("Dominant Estate"); and
~ WHEREAS, Grantor desires to grant and convey to Graz~tee
~ a perpetual, non-exclusive easement in, on, over, under and
~ through the Servient Estate in favor of and for the benefit of
~ Grantee and its assigns and all successors-in-interest and title
to the Domin~nt Estate for the purposes of (i) drainage from the
~ Dominant Estate by discharging into the Servient Estate and (ii)
~ irrigation of the Dominant Estate by drawing water from the
Servient Estate.

~ NOW, THEREFORE, for and in consideration of the
' premises, Ten and No/100 Dollars ($10.00) in hand paid by Grantee
~ to Grantor, and other good and valuab~e consideration, the
receipt and sufficiency of which are hereby acknowledged by
' Grantor, Grantor hereby agrees as follows:
1. Grantor hereby grants and conveys to Grantee a
perpetual, non-exclusive easement (Easement") in, on, over, under
the through the Servient Estate for the purposes of (i) drainage
from the Dominant Estate by discharging into the Servient Estate
and (ii) irrigation of the Dominant Estate by drawing water from
the Servient Estate.
~ 2. The Easement hereby granted and conveyed shall be
a cavenant running with the land which shall be binding upon
Grantor and its successors and assigns including, but not limited
