BEFORE ME, the undersiqned authority, duly qualified
and authorized in the State and County aforesaid to administer
oaths and take acknowledgments, this day, personally appeared
JOSEPH A. DUDA, who beinq by me first duly sworn, deposea and
says:
1. The facts and matters contained and recited in
this Affidavit are based upon personal~owledqe of the Affiant
and are true and correct as of January , 1990 (the "effective
' date" of this Affidavit).
2. Affiant is a Vice P=esident of A. Duda & Sons,
Inc., a Florida corporation. A. Duda ~ Sons, Inc. and Horizons
~ St. Lucie Associates, a Florida partnership, have fornted a joint
~ venture known as Horizons St. Lucie Groves Associates (the
"Partnership"), which is a general partnershig under the laws of
the State of Florida. The principal plac~ of business of the
Partnership is 1645 Palm Beach Lakes Boulevard, Suite 480, ~1est
Palm Beach, Florida 33401. The Partnership owns and holds title
to the reai property described in Exhibit "A°, attached hereto
and made a part hereof. A. Duda & Sons, Inc. and Horizons St.
Lucie Associates comprise all of the partners of the Partnership.
3. This Affidavit is given pursuant to Section
620.605, Florida Statutes.
