Period, all right, title and interest of Grantee in any of such
sod which has not then been removed from the Small Sod Parcel or
the Large Sod Parcel as aforesaid shall cease and terminate such
that said sod not then so removed shall be in all respects the
sole property of the then fee simple o~ner or owners of the Small
Sod Parcel and the Larqe Sod Parcei, respectively.
3. Grantee ahall at all times indemnify, defend and
hold Grantor harmless with respect to the Servient Estate, from
and against any and all claims, liabilities, losses, costs,
damages and expense$ (including reasonable attosneys' fees
whether incurred at or before the trinl 2eve1 or fn any appellate
or bankruptcy proceedinqs) which Grantor may suffer, sustain or
incur by reason of death, pereonal injury or property damage
(includinq, but not limited to, the filinq or ather encumbrance
of any mechanics or other lien or liens against the Servient
Estate), caused by acts or omissions of Grant~ee or its aqents,
employees o= independent contractors in connection ~ith the
exercise or utilization of the easements and/or riqhts specified
herein with respect to the Servient Estate.
4. The easements, riqhte, and indemnifications
granted herein shaZl be covenants running Mith the land which
shall be binding upon and inure to the benefit of Grantor and its
successors and assiqns, includinq, but not limited to, any
successor in title in and to all or any portion of the Servient
Estate and shall be binding upon and inure to the benefit of
Grantee and its successors and assiqns.
IN WITNESS WHEREOF, Grantor and Grantee have caused
this Easement to be executed and delivered and has intended the
same to be and become effective as of the day and year first
above written.
