Pierce subsequent holders of this note, are re(erred to as "Bank") at its oftice at _ ~FIQr~~ida, the principal sum of Nine Thousand Dollars and no/100 _ _ Oollars ' ~ ) with interest irom the date hareoi at the rate oi 11. 25 °Io per annum on the full amount of said principal sum remain1n trom time to time unpaid, payable in _ 6~ monthly installments of $ 196.80 _~ach on the 24t~ day ot each successive month commencing on Feb . 24 19 9~ The Maker promises to pay late charges not to exceed 5% 01 the amount oi any payment or paymenis in deTault. All payments made hereunder shall be credited firsl to interest and lawtul charges then accrued and the remainer to principal. Maker has the right to prepay this note, in whole or in part, without penalty at any time upon the payment of accrued and past due interest and charges to date ot prepayment plus a service fee in the amount oi the lesser of $50.00 or 2 percent of the principal amaunt of this ban (Amount Financed), provided, however, that any partial prepayment of principal shall be applied to the installment or inslallments ot principa! last maturing hereunder. The amounts reterred to above have been computed upon t~e assumption that aIi installment payments wili be made on the respective scheduled due dates. Interest accrues on ihe unpaid outstanding principal balance. I( any instaliment is nol paid in full on the due date, Maker witl be obligated to pay such additional amounts as may becocne payabte by reason of the continuing accrual ot interest at the rate designated above. Any resuiting charges accruing on account ot tailure to make timely payment on the due dates will cause increases in some of the amounts designated above. Any installment payment made prior to any due date or dates, or any prepayment, may cause decreases in some of ihe amounts designated above tor the reason that ihe unpaid outstanding principal balance will be reduced and the interest rate designated above is applied to such reduced outstanding balance to determine the amount ot interest ihat is due. If Bank deems itself insecure, or upon the happening of any of the following events, each ot which shatl constitute a default hereunder, ail liabilities of each Maker to Bank shall thereupon or thereafter, at the option ot Bank, without notice or demand, become due and payable: (a) tailure of any Obligor (which term shall mean and include each Maker, endorser, surety and guarantor of th9s ~~te) to perform a~, ~~oYisio!~ Qt any ser~!~ty agreement or mortga~e ~!~r~n; thP rP~ayment hereoi, to pav interest hereon when due, or to pay any other liabiliry whalsoever to Bank when due; (b) the death of any Obligor; (c) the tili??g of any petition under the Bankruptcy Code, or any similar federal or state statute by or against any Obligor; (d) an application for the aFpointment of a receiver or the making of a general assignment for the benefit of creditors by, or the insolvency of, any Obligor; (e) the entry of a judgment against any Obtigor; (f) the issuing of any writ of attachment or writ oi garnishment, or the fiting of any lien, against any property of any Obligor; (g) the taking oi possession of any substantial part oi the property of any Obligor at the instance oi any governmental authority; (h) the dissolution, merger, consolidation or reorganization of any Obligor; or (i) the assignment by any Maker of any equity in the real property which is security for this note, except as is pe?mitted under the terms of the mortgage, without the prior written consent of Bank. In addition to the mortgage securing this loan, Maker hereby grants to Bank a security interest in aii property of Maker now or at any time hereafter in the ~ssession of Bank in any Capacity whatsuever, including but not limited to, any balance or share of any deposit, trust, or agent account, as securiry for the payment of this note, and a similar lien upon anti security interest in atl such property oi each Maker as security for the payment of alt other liabiiities of each Maker to Bank (including a!I liabilities oi each Maker). The Obligors, jointly and severally, promise and agree to pay all costs and expenses of collection and reasonable attorneys' tees, whether incurred in connection with collection, trial, appeat or otherwise. Presentment, demand, protest, notice of dishonor, and extension ot time without notice are hereby waived by each and every Obligor. Makei acknowledges receipt of a completed copy of this note and mortgage on the above date. i NOTICE TO COSIGNER: You are being asked to guarantee this debt. Think carefu!ly before you do. It the borower doesn't pay the debt, you will have to. Be sure you can afford to pay if you have to and that you ; want to accept this responsibility. ( You may have to pay up to the ful! amount of the debt ii lhe borcower does not pay. You may also have to f pay late fees or collection costs, which increase this amount. ~ The Sank can collect this debt from you without tirst trying to collsct from the borrower.
