HomeMy WebLinkAbout2077 . ~ozzsz3 , ! i; ~ i:+.,•~~~ t~~•~:~i~t Ht-c r ; F ~ _r-r.------- ~ :a h'~~ : - _ 1__.. t' U~~. . . • _ ~ • :c :~f ~ r.,;;, PARTIAL RELEASE OF MOR`:GA~ , ~ ~ ~ AND RELATED DOCUMENTS L;;;~;.y c,1~:ric T,,_.,t ~ ~ WHEREAS, FLARIDA NATIONAL BANK, a National Banking Association, (hereinafter referred to as "Mortgaqee"), is the owner and holder ~ of a certain Mortqaqe and Security Agreement (h~reinafter referred to as "Mortgage"), dated July 15, 1988, and recorded July 20, 1988, in Official Records Book 595, Page 1827, Public Records of St. Lucie County, Florida; and WHEREAS, the above referenced Mortgage was executed by Harbour Ridge, Ltd., a Florida Limited Partnership, as Mortgagor, (hereinafter referred to as "Mortgagor"); and WHEREAS, Mortgagor has requested Mortgagee to release the premises hereinafter described, being a part of the mortgaged premises, from the lien and operation of the Mortgage. NOW, THEREFORE, Mortgagee, in consideration of the premises and the sum of Ten Dollars ($10.04) paid by Mortgagor at the time of ex~cution hereof, the receipt whereof is hereby acknowledged, does remise, release, quitclaim, exonerate and discharge from th~ lien and operation of the Mortgage, the ?and and improve~nents to ; the extent that it is part of the property encumbered by the ( ~ Mortgage described as: f 4 E ° UNIT 17, FAIRWAY VILLAGE, HARBOUR RID~GE PLAT NO. 10, according € to the Plat thereof on file in the Office of the Clerk of the ~ Circuit Court in and for St. Lucie County, Florida, recorded in Plat Book 2b, Pages 21 to 2I A. ~ ~ TO HAVE AND TO HOLD the same, with the appurtenances, to the ~ t Mortgagor freed, exonerated and discharged of and from the lien of ~ ~ the Mortgage, and every part thereof to the extent that it is a ~ t part of the property encumbered by the Mortgage, provided, that ~ F nothing h~rein contained shall in anywisP impair, alter or diminish ~ ~ the effect, lien or encumbrance of the Mortgage on the remaining part of the property encumhered by such Mortgage, not hereby releas~d therefrom, or any of the rights and remedies of the holder hereof. 4 This instrument shall also operate as a partial release of t ~ Mortgaqee's security interest in the properties described in those ~ ~ 90~K 67~ r AGF ~U - - - ; ~ - } ~ _ ~ x ~~~~~~~R~~
