PARTIAL RELEASE OF MORTGAGES L`c; t;~r':

AND RELATED DOCUMENTS
WHEREAS, HARBOR FEDERAL SAVINGS AIvD LOAN ASSOCIATION
(hereinafter referred to as "Mortgagee"), is the owner and holder
of certain Mortgages and Security Agreements (hereinafter referred
to as "Mortgages"), dated April 22, 1983, recorded in Official
Records Book 399, Page 1330, Public Records of St. Lucie County,
r~iorida; ciated april iu, 1yt34, recorded in Ofiicial Records BooKs
429, Page 2845, Public Records of St. Lucie County, Florida; and
dated May 7, 1985, recorded in Official Records Book 463, Page
2653, Public Records of St. Lucie County, Florida; and
WHEREAS, the above referenced Mortgages were executed by
Harbour Ridge, Ltd., a Florida Li~ited Partnership, as Mortgagor,
(hereinafter referred to as "Mortgagor"); and
WHEREAS, Mortqagor has requested Mortgagee to release the
premises hereinafter described, being a part of the mortgaged
premises, from the lien and operation of the Mortgages.
NOW, THEREFORE, Mortgagee, in consideration of the premises
and the sum of Ten Dollars ($10.00) paid by Mortgagor at the time
of execution hereof, the receipt whereof is hereby acknowledged,
does remise, release, quitclaim, exonerate and discharge from the
~ iien and operation of the Mortgages, the land and improvements to
the extent that it is part of the property encumbered by the
Mortgages described as:
UNIT I9, BUTTONBUSH VILLAGE, HARBOUR RIDGE PLAT NO. 13~
according to the Plat thereof on file in the Office of the
Clerk of the Cir.cuit Court in and for St. Lucie County,
Florida, recorded in Plat Book 28, Pages 3 to 3H.
TO HAVE AND TO HOLD the same, with the appurtenances, to the
Mortgagor freed, exonerated and discharged of and from the lien of
the Mortgages, and every part thereof to the extent that it is a
; part of the property encumbered by the Mortgages, provided, that
nothing herein contained shall in anywise impair, alter or diminish
the effect, lien or encumbrance of the Mortgages on the remaining
~ part of the progerty encumbered by such Mortgages, not hereby
released therefrom, or any of the rights and remedies of the holder
` hereof.
R This instrument shall also operate as a partial release of
s Mortgagee's security interest in the property described in those
; certain Financing Statements recorded in Official Records Book 399,
; Page 1338, and Amendment thereto recorded ~n Official Records Book
~ 595, Page 1817, Official Records Book 429, Page 2851, and Amendment
e thereto recorded in Official Records Book 599, Page 1822, and
r Official Records Book 463, Page 2668, and Amendments thereto
~ recorded in Official Records Book 566, Page 1827, and Official
~ Records Book 595, Paqe 1811, all Public Records of St. Lucie
~ County, Flarida, to the extent that the property described in the
Financing Statements is part of the property hereby released. This
instrument shall also operat~e as a partial release, as to the
property released hereby, from the terms and provisions of those
certain Collateral Assignments of Leases, Rents and Profits
recorded in Official Records Book 429, Page 2855, and Official
Records Book 463, Page 2663, and from the terms and provisions of
that certain Extension Agreement recorded in Official Records Book
472, Page 730, that certain Consolidation, Extension and
_ Modification Agreement recorded in Official Records Book 493, Page
456, that certain Promissory Note Modification and Extension
? Agreement recorded in Offi~ial Records Book 59~, Page 755, as
~ amended by Extension Agreement recorded in Official Records Book
595, page 780, and as further amended by that certain Subordination
