I~OTICE OF FUTURE ADVANCE AND ~
FIFTH MODIFICATION OF MORTGAGE AGREEMENT
THIS AGREEMENT is made and entered into the day
of DrT(,e.~-- , 1989, by and between EASTPORT ASSOCIATES, LTD. ,
a Florida limited partnership, hereinafter referred to as "East-
port", PDI ST. LUCIE I LIMITED PARTNERSHIP, an Ohio limited
partnerst?ip, hereinafter referred to as "PDI", and BARNETT BANK
OF SOUTH FLORIDA, N.A., hereinafter referred to as "Mortgagee".
W I T N E S S E T H:
WHEREAS, Eastport executed a Note ("Note") dated
September 25, 1986, in the original principal sum of NINE MILLION
TWO HUNDRED FIFTY THOUSAND AND NO/100 ($9,250,OOO.aO) DOLLARS and
i secured by a Mortgage and Security Agreement dated September 25,
1986, wr~i~r~ Mortgage and Security Agreement is recorded in
Official Records Baok 515, page 1887, of the Public Records of
St. Lucie County, Florida; and
~ WHEREAS, said Mortgage and Security Agreement was
~ modified by that certain Modification of Mortgage Agreement

; ("Modification") executed by Eastport and Mortgagee dated April

j 30, 1987 and record~d June 29, 1987 in Official Records Book 547,

Page 2714, of the Public Records of St. Lucie County, Florida;

f WHEREAS, the said Mortgage and Security Agreement was

~ further modified by that cer~ain Second Modificatian of Mortgage
~
~ Aqreem~nt ("Second Modificatian") executed by Eastport and

~ Mortgagee dated March 30, 1988 and recarded Marcr~ 31, 1988 in
~
~ Official Records Book 580, at Page 2226 of the Public Records of

~ St. Lu~ie County; Florida; and
WHEREAS, tY~e said Mortgage and Sscurity Agreement was
further modified by that certain Third Modification of Mortgage
Agreement ("Third Modification") executed by Eastport and
