Mungagur represent~ and warrants that if a corporatiun, it is duly org~nized and validly ezisting, in g~xxf sianding under the laws of the s!ate of its incorporation, has stock outstanding which has been duly and validly issued, and +s qualii`ied to do business and is in good standing in the State of Fturida, with Full power arxl authority to consum- mate the loan comtemplated hereby; and, if a partnership, it is duly lormed and validly existing, and is fuNy qua{ified to do business in the State of Florida; with full power and authority t~ consummate the foan contemplated hereby. 25. in the event any one or more of the provisions contained in this Mortgage or in the Note shall for any rea- son be held to be invalid, illegal or unenfucceable in any respect, such invalidity, iNegalily or unenforceabitiiy shalt, at th~: option of the Mortgagee, not affect any other provisiuns of this Mortgage, but this Martgage shalt be construed as if tuch invalid, illegal or unenforceable provision had never been contained herein or therein. The total interest payable pursuant to the Note or this Mortgage shall not in any one year exceed the highest lawFul rate of interest permitted in the State of Florida. " ~6. The covenants and agreements herein contained shall bind and the benefits and advantages shat) inure to the respective heirs, executors, administrators, successors, and assigns of the parties hercto.
