Know Al1 Men by These Presents:
WHEREAS, THOS. J. WHITE DEVELOPMENT CORPORATION. a Florida
corporation, ("Mortgag~r") is party to that certain Mortgage
dated April 19, ~989, and recorded in O.R. eook 632, page 2992;
Collateral Assignment of Rents and Leases recorded in O.R. Book
633, page 002; Collateral Assignment of Agreements of Sale recorded
iii O.R. Book 633, page 007; Cross Default Agreement recorded in O.R.
Book 633, page 012; UCC Financing Statement recorded in O.R.
Book 633, page 014; and Agreement and Subordination of Mortuage
r~c~zded ii~ C,.R. Booic 633, page 018, all of the public records
of St. Lucie County, Florida ("collectively referred to as
Mortgage"), in favor of BARNETT H~?NK OF ST. LUCIE COUNTY,
("Mortgagee"), the premises therein particularly described to
secu:e the aggregate sum of Three Million One Hundred Thousand
Dollars ($3,100,OQ0.00), with interest as therein mentioned.
WHEREAS, THOS. J. WHITE DEVELOPMENT CORPORATION, a Florida
corporation, t"Mortgagor") is party to that certain Mortgage
dated April 19, 1989, and recorded in O.R. Book 632, page 2992;
Collateral Assignment of Rents and Leases recorded in O.R. Book
633, page 002; Coll.ateral Assignment of Agreements of Sale recorded
in O.R. Book 633, page Ofl7; Cross Default Agreement recorded in O.R.
Book 633, page 012; UCC Financing Statement recorded in O.R.
Hook 633, page 014; and Agreement and Subordination of Mortgage
recorded in O.R. Book 633, page 018, all of the public records ~
of St. Lucie County, Florida ("collectively referred to as ~
Mortgage"), in favor of BARNETT BANK OF ST. LUCIE COUN'I'Y,
("Mortg~gee"), the premises therein particularly described to
secure the aggregate sum of Three Million One Hundred Thousand
; Dollars ($3,100,000.00;, with interest as therein mentioned. ~

` AND wHEREA~, Mortgagor/Assignor has requested the
; Mortgagee/Assignee to release the premises hereinafter
described, being part of said mortgaged and assigned premises, from
I the lien and operation of the Mortgages and Assignment;
NOW THEREFORE, KNOW YE, that the Mortgagee/Assignee, in
consideration of the premises herein and the sum of Ten
Dollars ($10.00}, to it paid by the Mortgagor/Assignor, at the
time of the execution hereof, the receipt whereof is hereby
acknowledged, remises, releases, quit-claims, exonerates and
discharges from the lien and operation of the Mortgages 3nd
Assignment unto the Mortgagor/Assignor, its heirs and assigns, all
that piece, parcel or tract of land being part of the premises
conveyed by the Mortgages/Assignment, to-wit:
Lot 130, HEATHERWOOD, St. Lucie West Plat No. 7, according to the Plat
~ thereof as recorded in Plat Book 27, Pages 8, 8A through 8G, Pub11c
Records of St. Lucie County, Florida.
' TO HAVE AND TO HOLD the same, with the appurtenances, unto
the said Mortgagor/Assignor, its heirs and assigns forever,
freed, exonerated and discharged of and from the lien
of the Mortgages/As~ignment, and every part thereof;
provided always, nevertY:eless, that nothing herein contained shall
in anywise impair, alter or diminish the effect, lien or
encumbrance of the Mortgages/Assignment on the remaining part of
said mortgaged/assigned premises not hereby released therefrom,
or any of the rights and remedies of the holder thereof.
