RESOLUTION N0. 87-17
A RESOLUTION AMENDING THE PROTECTIVE COVENANTS
REGULATING DEVELOPMENT AND USE AS TO THE
AIRPORT INDUSTRIAL PARK
WHEREAS, the Fort Pierce Port and Airport Authority has made
the following determinations:
1. By Resolution adopted on October 31, 1962, and recorded
in Official Record Book 49, at Pages 426 to 430, Public Records
of St. Lucie County, Florida, the Fort Pierce Port and Airport
Authority established certain Protective Covenants as to the
Airport Industrial Park, Unit 1, as recorded in Plat Book 12, at
Page 40, which were amended by Resolution adopted on April 28,
1965 and recorded in Official Records of St. Lucie County,
Florida: Resolution No. 67-07, adopted October 10, 1967;
Resolution No. 71-03 adopted December 14, 1971; Resolution No.
73-01, adopted February 20, 1973; Resolution No. 74-03, adopted
April 23, 1974; Resolution No. 86-08, adopted November 17, 1986;
Resolution No. 87-03, adopted February 16, 1987; Resolution No.
87-15, adopted October 5, 1987, and,
2. Paragraph 21, of Part C of the Protective Covenants
expressly reserves to the Fort Pierce Port and Airport Authority
the right to modify the Protective Covenants; and,
3. In order to more closely reflect the present land
development and zoning regulations of St. Lucie County and, to
ensure and protect the investment value made and existing within
the Airport Industrial Park, the Ft. Pierce Port and Airport
Authority recognizes the need to review, modify or delete, where
appropriate, these Protective Covenants.
NOW THEREFORE, BE IT RESOLVED, by the Fort Pierce Port and
Airport Authority that the Protective Covenants for the Airport
Industrial Park be amended to read as follows:

administration of the Fort Pierce Port and Airport Authority, or

Authority and the Federal Aviation Administration, no lot owner
or lessee in Block 7, Airport Industrial Park, Unit One, is
permitted unrestricted access to the St. Lucie County
International Airport Grounds, Taxiways or Runway Systems.

PART C - GENERAL
1. No noxious offensive trade or activity shall be performed,
nor shall anything be done on the premises which may be, or
may become, an annoyance or nuisance to other occupants of
the area by reason of unsightliness or the excessive
emission of odors, dust, fumes, smoke, or noise.

No building permit or construction authorization shall be
applied for until the Ft. Pierce Port and Airport Authority
has approved, by resolution, a site development plan for the
proposed construction. For the purpose of these Covenants,
all development plans, regardless of size, within the
Airport Industrial Park shall be prepared in accordance with
the requirements of Section 5.1.300, St. Lucie County Zoning
Ordinance. For those proiects requiring standard site plan
review, approval by the Board of County Commissioners is
required prior to presentation before this Authority.
No building permit or construction authorization shall be
issued for any building or structure in the Airport
Industrial Park until construction plans have been reviewed
and approved by the Ft. Pierce Port and Airport Authority.

exterior coverings and/or painting schemes to be used. The
ur ose of this review is to maintain a harmon of external
design and provide a visua ly appeal n development.

65. WATER SUPPLY: Each individual water supply system shall be
located, constructed and equipped in accordance with the
requirements of the St. Lucie County Public Health Unit and
Florida Department of Environmental Regulation. Fle~ida

later installed, the lessee or owner of each lot hereby
agrees, upon completion of same to discontinue the use of
the individual system and to connect to said community
supply system.
~6. SEWAGE SUPPLY: Each individual septic tank system shall be
located, designed and constructed in accordance with the
requ~.rements of the St. Lucie County Public Health Unit
Bepa~~meR~. In the event a community sewage disposal system
is later installed, the lessee or owner of each lot hereby
agrees, upon completion of samei to discontinue the use of
the individual septic tanks and to connect to said community
system.

1615.CHANGE IN USE: No change in use shall be permitted without

~~16.DEFINITIONS: Certain words used in these Protective
Covenants are hereby defined. Words used in the present
tense shall include the future; the singular includes the
plural; the plural includes the singular; the word
"building" includes the word structure; the word "shall" is
mandatory and not directory; the word "lot" includes the
words "plot," "tract," or "premises."
~817.TERMS: These Covenants are to run with the land for a period
of thirty (30) years from the date these Covenants are
recorded, after which time said Covenants, including any
changes or amendments thereof, shall be automatically
extended for successive periods of thirty (30) years.
1~18.ENFORCEMENT: Enforcement shall be by proceedings at law or
in equity against any person, firm or corporation violating
or attempting to violate any covenant, either to restrain
violations or to recover damages. The provisions of this
resolution may also be enforced and administered through the
Office of the St. Lucie County Community Development
Director. Violation of these Protective Covenants may
result in enforcement proceedings before the St. Lucie
County Code Enforcement Board.
8919.SEVERABILITY: Invalidation of any one of these covenants by
judgment or court order shall in no way effect any of the
other provisions, which shall remain in full force and
effect.

RIGHT TO MODIFY do VARIANCE:
The Ft. Pierce Port and Airport Authority hereby expressly
reserves the right in its absolute discretion at any time to
annul, waive, change, or modify any of the restrictions,
conditions, agreements and provisions contained herein as to
any lot not under lease or sold to any person, firm or
corporation. All resolutions executed in pursuance of this
paragraph shall be recorded in the public records of St.
Lucie County, Florida.
The Ft. Pierce Port and Airport Authority hereby expressly
reserves the right to varv anv of the dimensional
requirements contained herein, following a public hearing,
in accordance with the following standards:
a.) No variance shall be granted that would permit
construction or development within any
required yard as identified in Table I,
Section 3.2.400, St. Lucie County Zoning
Ordinance unless also approved by the St.
Lucie county boars or Aa~ustment in accoraance
with the requirements of Section 5.5.000, St.
Lucie County Zoning Ordinance.
b.) The variance requested arises from a condition
that is unique and peculiar to land structures
and buildings involved; that the particular

hardship t'or the owner, lessee, or occupant as
distinguished from a mere inconvenience, if
the provisions of these Protective Covenants

c.) The granting of the variance will not impair
or injure other property or improvements in
the area in which the subject property is
located, nor would it impair an adequate
supply of light or air to the adjacent
streets, increase the dangers of fire,
endanger the public safety, or substantially
diminish or impair the value of property
within the Airport Industrial Park.
d.) The variance granted is the minimum necessary
to overcome the particular difficulty in
compliance with these Protective Covenants.
e.) The variance requested is consistent with the
spirit and intent of these Protective
Covenants.
Any action taken by the Ft. Pierce Port and Airport
to grant any relief from the provisions of these
Protective Covenants, shall be done b Resolution
and said Resolution recorded in the public records
of St. Lucie Count
Should a particular variance be requested that would
require approval of the St. Lucie County Board of
Adjustment, prior approval from the Board of
Adjustment is required before presentation to this
Authority.
