THIS CAUSE was heard on NOVEMBER 29, 1982, upon the Motion for Enforcement and Contempt, previously filed herein. by the Petitioner, and the Respondent having not been~present in open court in person, and Che Petitioner ~ having been present in open court in_ person and represented by counsel, and the J Court having heard all of the testimony of the parties, the C~urt finds that the Responden[ had and ilas had the ability.to comply with the order of thts Court and _ fail~d to do so and the Court being otherwise fully and well advised in the ~ premises, it is thexefore ~ ADJUDGEU that the Respondent, w'ILLIE JAMES SCOTT, is guilty of willful contempt of this Court for failure to comply with the lawful orders of this Court concerning child support payments in the amount of $1064.00, amount due as of the da~e of hearing, and he is adjudged in contempt.of this Court and it is ORDERED AND ADJUDGED that as punishment for his contempt the Respondent " shall be immediately confined in the St. Lucie County Jai1; Fort Pierce, Florida, for a period of 30 days. The Respondent may purge himself by paying to the Clerk ~ of Gircuit Court.of this county on or, before his incarceration, the sum of $1064.OC~, p2us $2.00 statutory fee. Upon the failure of the Respondent to make payment in full of the aforesaid amount, y~u and your duly authorized deputies are ; therefore.and - ~ - - ~ ALL AND SINGULAR.THE SHERIFFS QF THE STATE 0~ FLORIAA are ordered to take into custady the above-named RespondenC as soon.as~ he can be found and ~ deliver him to the Sheriff of St. Lucie Gaunty, Florida, for the execution of the ~ above described ~jud~.ment and sentence. The Clerk of Circuit Court and this Court ~ shall be promptly notified of his arrest. It is further , ORDBRED AND ADJllDGED that rhe Clerk of Circuit C~urt shall and is hereby ~ ~ ordered to forward said arrearage payments received fro~ the Resporident until Che-~ ; ~ above arrearage is paid in .full to the Department of HealCh and Rehabilitative Services, Child Support Enforcement Section, 1317 Winewood Boulevard, Tallal~assee, Florida, 32304. The above arrearage payment shall be in additiori to the regular ~ support payment hereinbefore ordered by this Caurt and said payment shall ~ continue. Said regular support payment shall be sent by ttie Clerk of C~rcuit~ ~ ~ Court to the Department of Health and Rehabilitative Services unless a Notice has ~ ? been or is-filed by the Depart~ent directing said payment to.the custodial parent. ~ ` Additienally, it is hereby ordered pursuant to Chapter 82-140, Laws of ~ + F2orida (1982), that the emplayer of the Respondent shall deduct the sums herein ; ~ provided on a periodic basis from the ~.ncome due the Respondent and remit same; after deducting its c~arge for handling, Lo the Caurt Registry.. Such income deduction shall not ~ffective until the Respondent is delinc~uent in two (2)~ child support. payment~ and has failed to pay ala_ arrearages and past public assistance obligations. Service of this order on Che employer by the office of Child Support Enforcement of the Florida llepartment of Health and Rehabilitative Services shall be prina facie evidencP that the above conditior~s have occurred. ~ Upon receipt of this order, the employer shall govern himself accordingly and - ~ . remit paynent fortr.-a~th.
