' PetiCioner, . ~ . ~ 'vs' ORDER OF CONTEMPT ; AND INCOME DEDUCTTON CHARLES LLOYD, ~ - ResFondent. ~ ~ / T'HIS CAUSE was heard on NOVF.MBER 29, 1982,~ upon the Motion for ~ Enfarcement and Conte*.e~t ~reviously filed herein by Che Petitioner, and the Respondent having been present in open court in person, and the Petitioner having j been present in open court in person and represented by counsel, and the Court ~ ~ having heard all of. the test3mony of the parties, the Court finds that the ~ Resportdent had and has had the ability to comp]y with the Qrder of this Gourt and - failed to do so atid the Court being .otherwise fully~and~ well advised in the ' premises, it is therefore _ ~ ~ ` - ADJUAGED that the RespondenC,_ CHARLES LLOYD, is guilty o£ willful j contempt of this Courr for faiiure to comply with Che lawful orders of this Court ~ concerning child support payments, in the amount of .$875.00, amount due as of the t date of hearing, and he is ad~udged in contempt of this Caurt and it is ~ ~ ORDERED AND ADJUDGEU that as ~+unishment for. his contempt the~Responden[ shall be confined in the ~t. Lucie County Jail, Fort Pieree, Florida, for a period ~ of 30 days, that the sentence of contempt is suspended until AECE_MBER 14, 1982, ~ conditioned upon the Respondent p3yirrg to the Clerk of Circuit Court of this county on or before DEC~iBER 14, 1982, the sum of $$75.OQ, plus $2.00 statutory fee. Upon the failure of the Respondent zo ~:ske payment in full of the aforesaid - ; amount on or before DECEMBER 7.4, 1982, you and your duly authorized deputies are ' ~ therefore and ~ ~ ~ ALZ AND SItJGLiLAR THE SHERIFFS OF THE STATE OF FLORIDA are ordered to take intu custody the above-named Respondent as soo~ a~ he can be~found and deliver him to the Sheriff of St. Lucie County, Florida, for the.execuCion of the above described ~udgment and sentence. 1he Clerk of Circuit Court and this Court ~ _ shall be promptly notified c,f his arresx. ORDERED AND ADJUDGED that the Clerk of Circuit Court shall and is hereby i ordered to f.orward said arrearage payments received from the Respondent until the ~ above arrearage is" paid in full *_o the llepartn~ent of Health and Rehabilitative ~ Services, Child Support Enforc:ement Section, 1317 Winewood Bnulevard, Tallahassee, Florida, 323Q4. The above arrearage payment shall be in addition to the re~,ular . i _support payment hereinbefore ordered b}~ this Court and said payment shall { continue. Said regular-support payment shall be sent by the Clerk of Circuit . Court to the Department of Realth and R~habilitative Services unless a Notice has been or is filed by the Department directing said payment ta the custodial parent: ~ _ Additionally, it is hereby ordered pursuant to Chapter 82-140, Laws of ~ . Florida (1982), that the employer. of the Respondent shall deduct tl~e sums herein ~ provided on .a periodic basis from the income due the Respondent and.remit same, _ aftzr deducting its charge for-handling, Co the Court Registry. Such income . deduction shall not be effective until the Respondent is delinquent in tWO (2) child support paymen~s .and ha~ failed to pay all arrearages and past public assis~ance oblfgations. Service of this order on the employer by the office of Child Support Enforcement of the Florida Department of Health•an~l Rehabilitative Setvices shall be prima facie evidence that the above conditions have occuired. Upon receipt of this order, the employer shall govern himself accordingiy and remit payment forthwith. This income deducti~on order shall be in addition to, not in lieu of, a11 other remedies provided herein or hereafter. ORDERED AND ADJi1DGED that this order-of contempt does not a:~nul any j~ prior order(s) of contempt or order(s) relating.to_sup~ort arrearages.
