THIS CAUSE having come before the Court on the Department of Health and Rehabilitative Services' Petition for Reimbursement af AFDC moneys paid to, or ~n behalf of, the child(ren) of the Respondent and the Court being fully and well ~ advise~ in the premises, it is thereupon OI'iDERBD AND ADJUDGED as follows: ~ - 1. That commencing on DECEMBER 3, 1982, the Respondent shall pay $10.00 per month~, plus $2.00 sCatutory fee, until the AFDC is reimbursed in the amount of $153t~,00. Said amount includes.all arrears due herein. All payments ~ shall be made in _ash, money order or cashiers check. All.money orders and _ cashiers checks shall bear the payees name and Social Security Number and shall be # made payable to the CLERK Q~' THE CIRCUIT COURT, and sent to: CLERK OF CIRCUIT 4 COURT, SUPPORT DEPARTMENT,.P. 0. BOX 700, FORT PIERCE, FI.ORIDA, 33454. Said ~ amount shall be remitted monthly by the Clerk to the Department of Nealth and ~ Rehabilitative Services, Chi2~ Support Enforcement Unit, 1317 Winewood Boulevard, ~ Tallahassee, Florida, 32304. . 2. That the above reimbursement payment shall be in addition to tae regular support payment hereinbefore ordered by this Caurt and said payment shall continue until the minor child(ren) reaches majarity, dies or marries. Said regular support payment shall be sent .by the Clerk of Gircuit Court to the ( custodian of the minor child(ren) or in accordance. with__the most recent notice filed by the Departmer?t. However, should the AFDC money~ be reinst.ated, the ~ Petitioner ~sha11 file a notice of such reinstatement anc~ t~ie Clerk shall forward ~ regular s;~pport payments to tt?e Department or in accordance with the most iecent notice filed by the Department. For the time period the custodian of the minor ~ chil_d(ren) is receiving AFDC moneys, the reimburseaent paywent as set forth ahove ~ shall be deferred. Upon cancellation of AFDC maneys paid to, or on behalf of, the child{ren) the Department shall file a notice an~ the Respondent shali immediately ~ commence paying the reimbursement-payment as set forth above. The Clerk shall ~ forward said payments in accordance witt~ the a~ost recent notice filed by the s Department. " - . ~ 3. Additionally, it is hereby ordered pursuant to Chapter 82-140, Laws . of Florida (19t32), that`the employer of the Respflndent sna11 deduct the sums . herein provided on a periodic basis from the income ~ue the Respanaent and rer~it same, after deducting its ci~arge for handling, to the Court Registry. ~Such income ~ deduction shall not be effective until the Respond~nt is delinquent in two (2) i~ child support payments and has failed to pay all~ a*rearages ar.d past public ~ assistance obligations. Service of this ordex on the employer by the office of Child Suppart Enforcement of the Florida Department of Health and Rehabilitative Services shall be~prima~facie eyidence that the above conditions have occurred. - iJpon receipt of this order, the emp~oyer shall govern himself accordingly and remit payment forthwith.
