F.nforcement and Contempt previously filed herein by the Per_itioner, and the • Respondent having not been present in open courC in person, and the Petitioner ~ having been present in open court in person ~and represented b}~ counsel, and the . _ " Court having heard all of the testimony of the parties, the Court finds that the Respondent had and has had the ability to comply with the order of this Court and - failed to do so and the Court being otherwise fully and well advised in the premises, it is therefore ? ADJUDGED that the Respondent, SAAIU~L WAYNE HALL, SR., is guilty of i. _ w:Lllful conterapt of this.Court for failure to comply with the lawful orders of } this_Court concerning child support payments iri the amount of $825.00, acnount due ; as of the date of hearing, and he is adjudged in contempt of this Court and it is ORD~RED AND ADJUDGED that as punishment for his contempt the Respondent shall be immediately confined in the St. Lucie County Jail, Fort Pierce, Florida, for a period of 30 da~s. The Respondent may purge_himself by paying to the Clerk of Circuit Court of this county. on or before his incarceration, the sum of $825.00, plus $2.00 statutory fee. Upon the failure of the Respondent to make ~ payment in full of tiie aforesaid amount, you and your duly authorized deputies are : . i therefore and ~ : ALL AND SINGULAR THE SHERIFFS OF THE STATE OF FLORIDA are ordered to take into custody Ch~ abave-named Respondent as soon as he can be found and ~ deliver him to the Sheriff of St. Lucie County,~Florida, far the execu4io:~ of the above described ~udgment and sentence. The Clark cf Circuit Court and this Court shall be promptly notified of his arrest. It is further , ORDERED AND ADJUDGE~ that the Clerk of Circuic Court shall and is hereby ~ order~d to forsaard ,aid arrearage payments received~trom the Responc~ent until the ~ -above arrAaragz is pai.d in_full to the Department of Health and Rehabilitative . Services, Child Support Enforcement Section, 1317 Winewooo Boulevard, Tallahassee, . Florida, 32304. The above arrearage payment shall be in addition to ttie regular support payment hereinbefore ordere~ by this Court and said payment shall ~ continue. Said regular support payment shaZ.l be sent _by the Clerk ~f Circuit ~ ~ Court to the D~partmpnt of Health and Rehabilitative Services unless a Notice has t been or is filed by the Department di-recting said payment to the custodial parent. Additianally, it is hereby ordered pursuant to Chapter 82-140, Laws of Florida (1982)~ that the employer of_the Respondent.shall deduct the sur~s herein . provided on a periodic basis from the income due the RESpondent and remit same, ~ after deducting its charge for handling, to the Court Registry. Such income # deduction shall not bz effective until the Respandent is del~inqupnt in two (2) child support payments an~ has failed to pay all arrearages and past puhlic assistance obligations. Service of this order on the employer by the offi.ce of Chil~ Support Enforcement of the Florida Pepartment of Health and RehabiliCative F Services sh~Zl be prima facie evidence thaC the above condition~ have occurred. _ Upon receipt of this order, the_ employer shall_ govern hi~self accordingly and remit payment forth~aith. This income deduction nrder siiall bs ~n addition to, not , i.n lieu of, all other remedies provided herein or herea_fter. } . ORDERED AND ADJUDGED that this order of contempt does_not annul any ~ prior order(s) of contempt or order(s) relating to_support arrearages.
