DEPARTMFNT OF HEALTEI AND REHABILITATIVE ( SERVICES OF TH~ STAT~ OF FLORIDA, etc., ; Petitioner, ~ -vs- ~ ORDER 01~ CONTEMPT AND INCOME DEDUCTION GER.ALDINE TAYLOR, ! ; Respondent. . ~ THIS CAUSE was heard on NOVEMBFR 29, 1982, upon the Motfon f~r Enforcement and Contempt previously filed herein by the P.etitioner, and the f Respondent having not been present in open court. in person! and the P~titioner having be~n present in open court in person and repreaented by counsel, and the Court having heard all of the testimony of the parties, the C~urC finds that the Respondent had and has had the ability to comply wi[h the order of th~.~ Court and - failed to do so and the Court being otherwise fully and well advised in the ~ premises, it is therefore . . ADJUDGED that the Respondent, GBRAI.DINE TAYLOR, is guilty of willful contempt of this Court for failure to comply with the lawful orde~s of this Court concerning child support payments in the amount-of $770.00, amount due as of the date of hearing, and he is ad~udged in cotltempt af this Court and it is _ ORDERBD AND ADJUDGED that as punishment for tiis contempt the Respondent ~ shall be immediately confined in the St. Lucie County Jail, Fort Pierce, Florida, . for a per.iod of 30 days. The Respondent may purge himself by paying to the Clerk ' of Circeiit Court of this county on or before his i.ncarceration, the sum of - $770.00, plus $2.00 statutory fee. tTpon the fai_lure of the Respondent to make ~ payment in full or the aforesaid amount, you and your duly authorized deputies are ~ F therefore and . . ALL AND SINGULAR THE SHERIFFS OF THE STATE OF FLORIDA are ordered to take into_ custudy the above-named Respondent as soon as he can be found and - deliver him to the Sheriff of St. Lucie ~'.ounty, Florida, for the executian of thE ~ abo~?~ described judgment and sentence, The Clerk of Circuit Court r~ttd this Cou.rt i _ shall be promptly notified of his arrest. It is further . ! ORDERED AND ADJUDGED that the Clerk of Circuit Court shall and is hereby ~ ordered to forward said arrearage payments received from the Respondent until the - above arrearage is paid in full to the Department of Health and Rehabilitative Services, Chitd Support Enfarcement Section, 1317 Winewood Boulevard, Tallahassee, ~ Florida, 32304. The above arrearage payment shall be in addition.to the regular ; supporC payment hereinbefore ordered by this Court and said payment shall ~ continue. Said regular supporC payment shall be sent by the G?erk of Circuit Court to ~he Department of Health and Rehabilitative Services unless a IJotice has ~ been or is filed by the Department directing~said payment to the custodial parent. Additionally, it is hereb~ ordered pursuant to Chapter 82-140, Laws of Florida (1982), that the employer of the Respendent shall deduct the sums herein ~ provided an a periodic basis from the income due the Respondent and remit same,. ~ . after deducting its charge for handling, to the Court Registry. Such income ~ deduction shall not be effective until the Respondent is. delinquent in tWO (2) ~ clnild support paym~nts and has failed to pay all arrearages and past public ~ assistance obligaCions. Service of this order on the empZoyer by the office of € Child Support Enforcement of the~F~orida Department of Health and I~ehabilitative t- Services shall be prima facie evidence that the above.conditions have occurred. Upon receip~ af t~is order, the empl.oyer- shall govern himself accordingly. and rec~it payment forthwith. This income deduction arder sha11 be i~ addi-*_i~n to, rQt in Iieu of, all other remedies provided herein or hereafter. - - ORDERED AN~J ADJUDGED that this order of coatempt do~s not annul any ~ prior order(s) of contempt or order(s) relating to support arrearages.
