A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA,
AMENDING RESOLUTION NO. 05-118 TO MODIFY
EXHIBIT 6 "2005 PROJECT" TO PROVIDE FOR THE
ACQUISITION AND LEASE OF, PURCHASE OF
CONSERVATION EASEMENTS ON, ENHANCEMENT AND
IMPROVEMENTS TO 6REENWAYS do TRAILS LANDS,
ENVIRONMENTALLY SENSITIVE AND SIGNIFICANT
LANDS AND OTHER LANDS TO BE USED OR IMPROVED
FOR ENVIRONMENTAL PURPOSES; PROVIDING FOR AN
EFFECTIVE DATE/
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE
COUNTY, FLORIDA:
Section 1. Authority for this Resolution. This resolution is adopted pursuant to
the provisions of Chapter 125, Florida Statutes, Ordinance No. 87-77 of the County, other
applicable provisions of law (collectively, the "Act").
Section 2. Findings. It is hereby ascertained, determined and declared that:
A. On Mny 17, 2005, this Board adopted Resolution No. 05-118 authorizing the
Acquisition and Construction of Capital Improvements within the County and Acquisition of
Environmentally Sensitive Lands.
B. This Board desires to amend Resolution No. 05-118 to modify Exhibit "G" "2005
Project".
Section 3. Exhibit 6 "2005 Project" is modified to rend ns follows:
The 2005 Project consists of the acquisition and lease of,
purchase of conservation easements on, enhancements and
improvements to 6reenways ~ Trails lands, Environmentally
Sensitive and Significant Lands and Other Lands to be used, or
improved for environmental purposes; provided that the Board
shalt have the discretion to designate alternate or other uses as
the 2005 project, subject to receipt of an opinion of Bond
Counsel that such an alternate or other uses are a permissible
use of the proceeds of the Series 2005 Bonds under the
provisions of the Code.
Section 4. Effect on Prior Resolution. Except as amended herein, the remaining
terms and conditions of Resolution No. 05-118 shall remain in full force and effect.
Section 5. Effective Date. This resolution shall take effect immediately upon its
adoption.
Passed and Adopted by the Board of County Commissioners at a regular meeting duly
called and held this 9'h day of November 2010.
