DEEJ Investments. LLC presented a petition for Minor Site Plan approval for the project to be known as Surgical Specialists of St. Lucie County Minor Site Plan located on the east side of US-1, % mile south of Kitterman Road, in the CG (Commercial General) Zoning District and as described in Part B, consisting of a 12,018 square foot outpatient surgical building. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to be in compliance with all technical requirements of the St. Lucie County Land Development Code and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 4. The proposed project will not have an undue adverse effect on adjacent property the , character of the neighborhood, traffic conditions, parking, utility facilities or other ~ c matters affecting the public health, safety and general welfare. ~ 5. All reasonable steps have been taken to minimize any adverse effect of the ~ ° proposed project on the immediate vicinity through building design, site design W , landscaping and screening. ? ~ ~ 6. The proposed project will be constructed, arranged and operated so as not to LL M ~ g N interfere with the development and use of neighboring property, in accordance with ~ i= N ~ applicable district regulations. z ~ W ' ;QB 7. The proposed project will be served with water and sanitary sewer provided by City x o ~vga~. W ~ ~ ~ z of Port St. Lucie Utilities Department. a ~ 8. A Certificate of Capacity as required under Chapter V, St. Lucie County Land ~QJRW ~ N ~- o Development Code, a copy of which (C of C #2846) is attached to this administrative development order as Exhibit "A", granted by the Planning & Development Services Director on September 9, 2010. 9. A condominium, DEEJ Commerce Center as recorded in St. Lucie County Official Record Book 2950 Page 2762, has been created for the provision of: common Page 1 Planning & Development Services Order 10-012 September 8, 2010 File No.: MNSP 720093991 access for ingress and egress; maintenance of common improvements and landscaping; and the equitable distribution of common expenses. NOW THEREFORE, BE IT ORDERED by the Director of Planning & Development Services of St. Lucie County, Florida: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Minor Site Plan to be known as Surgical Specialists of St. Lucie County, is hereby, approved as shown on the site plan drawings for the project prepared by CAPTEC Engineering on July 22, 2009, last revised on July 31, 2010 and date stamped received by the St. Lucie County Planning & Development Services Department on August 16, 2010 subject to the following conditions: No development permits shall be issued until complete sets of sealed constructible final engineering plans, supporting calculations and survey data for the site work and offsite improvements are approved by the Office of the County Engineer, Public Works Department, Utilities Department, Environmental Resources Department, Planning & Development Services Department, Fire Department, and any other agency that may be determined by the Director of Planning ~ Development Services to be necessarily involved in the review and approval of the constructible final engineering plans for the site work and offsite improvements. The determination of whether or not plans submitted by the applicant constitute a complete set of constructible plans shall be made by the departments involved in the plan review within five business days of the date the plans are received in the Department of Planning & Development Services. 2. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall submit a revised landscape plan showing the following: a. A continuous four (4) foot hedge along the eastern property boundary; and b. Either a shared driveway/sidewalk adjacent to Lot 2 or a ten (10) foot landscape strip planted with a four (4) foot tall hedge and one (1) tree per thirty (30) feet between the vehicular use and the adjacent property. 3. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall provide a fee in lieu to the St Lucie County Tree Mitigation Fund in the amount of $92,200 for the required tree mitigation. 4. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall finalize an improvement agreement acceptable to Environmental Resources Department covering the cost of all required landscaping, irrigation, tree mitigation, tree relocation, and related improvements shown in the site plan. A copy of this agreement can be obtained by visiting the SLC Environmental Resources Department website at: http://www.stlucieco.org/Environmental Resources Department/index htm. 5. The applicant will comply with any state and federal agency regulations and requirements. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall have obtained and provided Environmental Resources Department with copies of any required federal and state permits, including but not limited to a Florida Page 2 Planning & Development Services Order 10-012 September 8, 2010 File No.: MNSP 720093991 Fish and Wildlife Conservation Commission Gopher Tortoise Relocation Permit. I' federal or state agency compliance requires modification to the development plans, the applicant will promptly modify the plans and submit to SLC for review and approval a: required by the LDC. The applicant will not use the County's development approval tc prevent compliance with any federal or state agency requirements. B. The property on which this Minor Site Plan approval is being granted is described as follows: UNIT 3 OF DEEJ COMMERCE CENTER, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 2950, PAGE 2762, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY,.AND ANY AMENDMENTS THERETO, TOGETHER WITH ITS UNDIVIDED SHARE IN THE COMMON ELEMENTS. Property Tax ID# 3415-800-0003-000-0 C. The Director of Planning & Development Services shall coordinate the issuance of further site Development Permits. No final site construction authorizations or site Development Permits shall be issued until all requirements for such permits are met. D. This administrative development order shall be recorded in the Public Records of St. Lucie County. The recording of this administrative development order does not authorize commencement of any on-site development activities without obtaining such further development permits as may be required. All applicable conditions of approval as set forth above, and applicable code requirements must be met to satisfaction of the County before final site construction permits are issued. E. A copy of this order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. F. The conditions set forth in Part A are an integral nonseverable part of the Minor Site Plan approval granted by this administrative development order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this administrative development order shall become null and void. G. This Minor Site Plan development approval shall expire on September 8, 2012, unless an extension is granted in accordance with Section 11.02.06(8)(1), St. Lucie County Land Development Code or unless a building permit is secured. H. This order shall be recorded in the Public Records of St. Lucie County.
