4 AN ORDER GRANTING APPROVAL FOR A MINOR
5 SITE PLAN PROJECT T4 BE KNOWN AS MIDWAY
6 REFUELING STATION

8 WHEREAS, the Director of the Planning & Development Services Department of St. Lucie
9 County, Florida, has reviewed the application far site plan approval and based on the
10 review and recommendation of the St. Lucie County Development Review Committee,
11 including but not limited to the staff report, has made the fallowing determinations:
12
13 1. Lang Term Finance and Development, LLC presented a; petition far Minor Site Pian
14 approval for the project to be known as Midway Re#ueling Station far the property
15 located at the northwest corner of South 25t" Str et and Midway Road, in the CG
16 (Commercial General) Zoning District and as escribed in Part B, consisting of a
17 2,600 square foot convenience store/gas stat on and a 876 square foot car wash.

19 2. The Development Review Committee has reviewed the site plan for the proposed
20 project and found it to be in compliance with ail technical requirements of the St.
21 Lucie Gaunty Land Development Cade and to be consistent with the Future Land
22 Use Maps of the St. Lucie County Comprehensive Plan.

24 3. The proposed project is consistent with the general purpose, goals, objectives and
25 standards of the St. Lucie County Land Development Code, the St. Lucie County
26 Comprehensive Plan, and the Code of Ordinances of St. Lucie County.

2$ 4. The proposed project ;;riH not have a~i undue adverse effect an adjacent property, the
29 character of the neighborhood, traffic conditions, parking, utility facilities or other
34 matters affecting the publ"sc health, safety and general welfare.

32 5. Ail reasonable steps have been taken to minimize any adverse effect of the
33 proposed project on the immediate vicinity through building design, site design,
34 landscaping and screening.

36 6. The proposed project will be constructed, arranged and operated sa as not to
37 interfere with the development and use of neighboring property, in accordance with
38 applicable district regulations.

40 7. The proposed project will be served with water and sanitary sewer provided by the
41 Fart Pierce Utilities Authority.

43 8. A Certificate of Capacity as required under Chapter V, St. Lucie County Land
44 Development Code is attached to this order as Exhibit "A", granted by the Planning 8~
45 Development Services Director on October 11, 2010.

4 A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the
5 Minor Site Plan to be known as Midway Refueling Station, is hereby, approved as
6 shown on the site plan drawings for the project prepared by Culpepper and
7 Terpening, Inc. on January 7, 2010, and date stamped received by the St. Lucie
8 County Planning & Development Services Department on August 27, 2010 subject to
9 the following conditions:

11 1. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant
12 shall finalize an )mprovement Agreement acceptable to the Environmental
13 Resources Department covering the cast of all required landscaping, irrigation,
14 tree mitigation, tree relocation, and related. improvements shown. in the site plan.

19 2. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall
20 obtain and provide to the Environmental Resources Department copies of any
21 federal and state permits/authorizations (or notices of intent to issue same}. The
22 preceding shall not preclude or delay the issuance of local building permits or
23 authorizations for development activities that are not dependent on the prior
24 issuance afi state or federal permits or authorizations, or notices of intent to issue
25 same. )fi federal ar state agency compliance requires modification to the
26 development plans, the applicant will promptly modify the plans and submit to St.
27 Lucie County for review and approval as required by the Land Development Cade.
28 The applicant will not use the County's development approval to prevent
29 compliance with any federal or state agency requirements.

31 3. Prior to the issuance of the first building permit, the applicant, successor ar ',
32 assign shall pay $15,750.00 to the St. Lucie County Community Services -
33 Transit Division for costs associated with a bus shelter and other transportation
34 amenities which will be used to serve the project area.

36 4, Within 90 days after receiving minor site plan approval, the applicant shall
37 enter into a Proportionate Fair Share and Impact Fee Credit Agreement for
38 the roadway improvement costs associated with Midway Road.

40 5. Prior to the issuance of a right of way permit, the applicant shall execute a
41 Road Improvement Agreement with St. Lucie County and submit a surety
42 for the proposed public improvements. The amount of surety shall be 115%
43 of the engineer's estimate of probable cost. Farm of surety shall be
44 approved by the County Attorney. The Agreement shall be approved and
45 signed by the County Administrator or designee.

1 I 6. Prior to the issuance of the Road Improverrrlent Agreement, the applicant
2 shall submit two (2) sets of signed and sealed construction plans for

9 C. The Director of Planning & Development Services shall coordinate the issuance of
10 further site Development Permits. No final site construction authorizations or site
11 Development Permits shall be issued until all requirements for such permits are met.

13 D. This administrative development order shall be recorded in the Public Records of St.
14 Lucie County. The recording of this administrative development order does not
15 authorize commencement of any on-site development activi#ies without obtaining such
16 further development permits as may be required. Alt applicable conditions of approval
17 as set forth above, and applicable code requirements must be met to satisfaction of
1$ the County before final site construction permits are issued.

20 E. A copy of th'ss order shall be attached to the site plan drawings described in Part A,
21 which plan shall be placed on file with the St. Lucie County Planning & Development
22 Services Director and mailed, return receipt requested to the developer and agent of
23 record as identified on the site plan applications.

25 F. The conditions set forth in Part A are an integral nanseverable part of the Minor Site
2b Plan approval granted by this administrative development order. If any condition set
27 forth in Part A is determined to be invalid ar unenforceable for any reason and the
28 developer declines to comply voluntarily with that condition, the site plan approval
29 granted by this administrative development order shall become null and void.

31 G. This Minor Site Plan development approval shall expire on ®ctober 11, 2012, unless
32 an extension is granted in accordance with Section 11 A2.06{B}{1 }, St. Lucie County
33 Land Development Code or unless a building permit is secured.

3S N. This order shall be recorded in the Public Retards of St. Lucie County.
