9 LUCIE COUNTY, FLORIDA.

ii WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
ia application for a minor adjustment to a major site plan submitted by Lucido & Associates, Inc. on
13 behalf of Save the Chimps, Inc. and reviewed the comments of the St. Lucie County
i4 Development Review Committee on this application, and made the following determinations:

i6 1. Save the Chimps, Inc has proposed 10,150 square foot maintenance building to the
i~ existing Center for Captive Chimpanzee Care facility on 190.66 acres located at the
ia southeast corner of Header Canal Road and Carole Noon Lane in the AG-5
i9 (Agricultural - 5) Zoning District on the property legally described in Part B. This
ao adjustment includes the following:
ai • The conversion of the existing administration building to the kitchen/staff offices.
aa • The conversion of the proposed kitchen building/staff offices identified on the
a3 approved site plan to a maintenance building located further south of the kitchen
a4 building.
a s • The relocation of the stabilized parking spaces previously approved for the proposed
a6 kitchen further north near the existing administration trailer.
a~ • The addition of 20 stabilized park spaces near the administration trailer.
as • The addition of a retention lake and stabilized, internal access way to service the
a9 proposed maintenance building.

3i 2. On December 16, 2003, through Resolution No. 03-245, the Board of County
3a Commissioners granted approval of a major site plan known as the Center for Captive
33 Chimpanzee Care, which is a non-profit organization that rehabilitates and provides safe
34 harbor for adult chimpanzees.

36 3. The Development Review Committee reviewed the minor adjustment to the major site
3 ~ plan for the proposed project and found it to meet technical requirements of the Land
3 s Development Code and to be consistent with the St. Lucie County Comprehensive Plan.

4 0 4. The project is consistent with the general purpose, goals, objectives, and standards of
4i the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development
4a Code.

44 5. The project will not have an undue adverse effect on adjacent property, the character of
45 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the
46 public health, safety, and general welfare.

a 6. All reasonable steps have been taken to minimize any adverse effect of the proposed
3 project on the immediate vicinity through building design, site design, landscaping, and
4 screening.

6 7. The project will be constructed, arranged, and operated so as not to interfere with the

a regulations.

i3 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land

i6 NOW, THEREFORE, BE IT ORDERED:

is A. Pursuant to Section 11.02.04 (C) of the St. Lucie County Land Development Code, the
19 Minor Adjustment to the Major Site Plan for the project to be known as Save the Chimps
a o (fka Center for Captive Chimpanzee Care) as shown on the site plan and landscape plan
a i (prepared by Lucido & Associates) for the project date stamped received by the St. Lucie
aa County Planning and Development Services Department on November 10, 2010 is being
a3 granted, subject to the following conditions:

as 1) Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant
a 6 shall have obtained and provided the Environmental Resources Department with all
z~ required federal and state permits and approvals. If federal or state agency compliance
as requires modification to the plans, the applicant will promptly modify the plans and
z 9 submit to St. Lucie County for review and approval. The County's development approval
3o shall not prevent compliance with any federal or state agency requirements.
3i 2) Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant
3z shall finalize an Improvement Agreement acceptable to the Environmental Resources
33 Department covering the cost of all required landscaping, irrigation, and related
34 improvements shown in the site plan. A copy of this agreement can be obtained by
35 visiting the St. Lucie County Environmental Resources Department website at:

9 C. The approvals granted by this administrative order shall expire on November 12, 2012
io unless building permits are issued or an extension is granted in accordance with the
ii provisions of Section 11.02.06 of the St. Lucie County Land Development Code.
ia D. The Final Site Plan approval granted under this order is specifically conditioned to the
i3 requirement that the petitioner, Save the Chimps, Inc. including any successors in
i4 interest, shall obtain all necessary development permits and construction authorizations
i5 from the appropriate State and Federal regulatory authorities including, but not limited to:
i6 the United States Army Corps of Engineers, the Florida Department of Environmental
1~ Protection, and the South Florida Water Management District, prior to the issuance of
is any local building permits of authorizations to commence development activities on the
i9 property described in Part B.

ai E. The conditions set forth in Part A are an integral nonseverable part of the site plan
aa approval granted by this Resolution. If any condition set forth in Part A is determined to
a3 be invalid or unenforceable for any reason and the developer declines to comply
a4 voluntarily with that condition, the site plan approval granted by this resolution shall
a5 become null and void.

z~ F. A copy of this Order shall be attached to the site plan drawings described in Part A,
a s which plan shall be placed on file with the St. Lucie County Planning and Development
z9 Services Director and mailed, return receipt requested to the developer and agent of
3 o record as identified on the site plan application.

3 z G. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as
3 3 this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
34 automatically terminate.

36 H. This order shall be recorded in the Public Records of St. Lucie County.
