LUCIE ~ INDUSTRIAL PARK 8 9 This document is beina re-recorded due to an error in the orevious document recorded m OR Book 3242 Pa9e 1000-1004 11 12 WHEREAS, the Director of the Planning 8 Development Services Department of St. Lucie 13 County, Florida, has reviewed the application for site plan approval and based on the 14 review and recommendation of the St. Lucie County Development Review Committee, 15 including but not limited to the staff report, has made the following deteRninations: 16 17 1. St. Lucie Industrial Park LLC presented a petition for Minor Site Plan. approval for 18 the project to be known as St. Lucie Industrial Park for the property located 19 approximately Y. of a mile east of Sapp Road, south of St. Lucie Boulevard, in the IL 2~ (Industrial Light) Zoning District and as described in Part B, consisting of an 80.04 21 acre parcel of land divided into three (3) tracts; a drainage tract, a preservation tract, 22 and a tract for future development. 23 24 2. The Development Review Committee has reviewed the site plan for the proposed 25 development and found it to be in compliance with all technical requirements of the 26 St. Lucie County Land Development Code and to be consistent with the Future Land 27 Use Maps of the St. Lucie Counry Comprehensive Plan. I 28 I 29 3. The proposed project is consistent with the general purpose, goals, objectives and 30 standards of the St. Lucie Counry Land Oevelopment Code, the St. Lucie County 31 Comprehensive Plan, and the Code of Ordinances of St. Lucie County. ~ 32 33 4; The propo5ed project will not have an undue adverse effect on adjacent property, the I 34 character of the neighbofiood, Vaffic conditions, parking, utility facilities or other 35 matters affecting the public health, safety and general welfare. I 36 37 5. All reasonable steps have been taken to minimize any adverse effect of the I ~ 3g proposed project on the immediate vicinity through building design, site design, 39 landscaping and screening. 40 41 6. The proposed project will be constructed, arranged and operated so as not to 42 intertere with the development and use of neighboring property, in accordance with 43 applicable district regula6ons. 44 ~ 45 7. The proposed project will be served with water and sanitary sewer provided by the 46 Fort Pierce Utilities Authority. 47 I 4g 8. Capacity as required under Chapter V, St. Lucie County Land Development Code is 49 not reserved and will be required to be reserved prior to any development on the 50 subject property. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the g Minor Site Plan to be known as St. Lucie Industrial Park, is hereby approved as 9 shown on the site plan drawings for the project prepared by Jordan Jones and 1~ Goulding on October 5, 2010, and date stamped received by the St. Lucie County 11 Planning 8 Development Services DepaRment on October 11, 2010 subject to the 1z following conditions: 13 14 1) Prior to issuance of a Vegetation Removal Permit, the applicant must provide the 15 Environmental Resources Department with a copy of an approved gopher 16 tortoise relocation permit from the Florida Fish and Wildlife Conservation 17 Commission. Relocation activities must be completed pnor to initiation of site 1 g clearing for development. I 19 I 20 2) Prior to issuance of a Vegetation Removal Permit, if more than one year or i 22 nesting season has elapsed since the most recent listed species surveys were conducted in accordance with appropriate state and/or federal protocols, updated 23 surveys shall be required for the gopher tortoise, as well as any other listed 24 species for which the state or federal govemment have required updated ' 25 surveys. Surveys should be conducted in accordance with appropriate state 26 and/or federal protocols, and documentation of survey methods and results shall I 27 be provided to the Environmental Resources Department, as well as the 28 appropriate state and/or federal agencies. In the event that the applicant obtains i 29 written documentation from the US Fish and Wildlife Service for federally-listed 30 species or the Florida Fish and Wildlife Conservation Commission for state-listed 31 species, indicating that updated surveys will not be required for this project, this 32 condition of approval will be considered addressed. 33 34 3) Prior to issuance of a Vegetation Removal Permit, the applicant shall have 35 obtained and provided the Environmental Resources Department with copies of 36 any required federal and state permits, including but not limited to a US Fish and 37 Wildlife Service (FWS) Incidental Take Permit and associa ted FV1/S-a 38 pproved Habitat Conservation Plan. If federal or state agency compliance requires 39 mod~cation to the development plans, the applicant will promptly modify the ~ plans and submit to St. Lucie County for review and approval as required by the 41 Land Development Code. The applicant will not use the County's development 42 approval to prevent compliance with any federal or state agency requirements. I 43 ~ a. The date of the approval of this Minor Site Plan shall be the date of issuance 45 of the pending US Fish and Wildlife Service Incidental Take Permk. Within 46 90 days of the date of approval of this Minor Site Plan or rior to issu 47 a Vegetation Removal Permit, whichever comes first, he applicant shall 48 provide the required executed St. Lucie County conservation easement and 49 the Environmental Resources Department-approved Preserve Area Page 2 oaoear 20, zo~o Planning & Development Services Order 10-017 I File No.: MNSP 06ppg OR BOOK 3253 PAGE 1472 I ~ ~ I 1 Monitoring and Management Plan (PAMP) with an attached affidavit, and a i 2 cashiers check, payable to the Clerk of the Court for the appropriate I 3 recording fees, to the County Attomey for review and approval. Any 4 additional easement specifications required by the US Fish and Wrldlife 5 Service (FWS), including designation of the FWS as a third party with 6 enforcement rights, shafl be incorporated into the document. A copy of the 7 conservation easement document can be obtained by contacting the St. 8 Lucie County Environmental Resources Department Planner. Prior to 9 recordation, the PAMP shall be revised to include reference to the Scrub-Jay 1~ Habitat Conservation Plan. 11 12 4) Prior to issuance of a Vegetation Removal Permit , the applicant shall finalize 13 an Improvement Agreement acceptable to the Environmenial Resources 14 Department (ERD) covering the cost to purchase and install all required IS landscaping, irrigation, any relocated trees, and related improvements shown 16 in the approved landscaping plan. A copy of this agreement can be obtained 17 by visiting the St. Lucie County Environmental Resources Department 18 website at: htto://www stlucieco or4/erd/index htm. I 19 20 5) Within ninety (90) days after receiving minor site plan approval, the applicant 2~ shall convey the required road right of way for St. Lucie Boulevard. Manner 22 and form of conveyance shall be acceptable to the Counry Attomey. The 23 sketch and legal description shall be prepared by a Florida licensed surveyor 24 and mapper. Pursuant to Chapter 7.05.03 of the St. Lucie Land Development ZS Code, the applicant may be granted credits against road impact fees. 26 27 B. The recording of this administrative development order does not 43 authorize commencement of any on-site development activities without obtaining such 44 further devetopment permits as may be required. All applicable conditions of approval 45 as set forth above, and applicable code requirements must be met to satisfaction of I 46 the County before final site construction permits are issued. 47 48 D. The conditions set forth in Part A are an integral nonseverable part of the Minor Site 5 Plan approval grarrted by this administrative development order. If any condition set 6 forth in Part A is determined to be invalid or unenforceable for any reason and the 7 developer declines to comply voluntarily with that condition, the site plan approval 8 granted by this administrative development order shall become null and void. 9 10 F. This development approval shall expire two (2) years from the effective date on 11 October 20, 2012 unless an extension is granted in accordance with Sec6on 12 11.02.06(B)(1), St. Lucie County Land Development Code. 13 14 G. This order shall be recorded in the Public Records of St. Lucie County. IS 16 H.
