6 PLAN KNOWN AS PORT ST. LUCIE SOCIAL SECURITY ADMINISTRATION

9 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
1 o application for minor adjustment to a minor site plan approval submitted on behalf of R~S Port
11 St. Lucie, LLC and reviewed the comments of the St. Lucie County Development Review
12 Committee on this application, and made the following determinations:

14 1. On November 6, 20U9, the Planning and Development Services Director approved the
15 petition of R8~S Port St. Lucie, LLC for a Minor Site Plan approval for the development
16 of a 15,719 square foot office building on 1.57 acres located approximately mile
l~ south of Kitterman Road on the east side of US Highway No. 1.

19 2. The petitioner, R&S Port St. Lucie, LLC, is now seeking approval for a minor adjustment
2o to the previously approved Minor Site Plan known as Port St. Lucie Social Security
21 Administration Building amending development order GM 09-021.

23 3. On December 16, 2010, the Development Review Committee reviewed the minor
24 adjustment for the proposed project and found it to be consistent with the previously
2 s approved Site Plan for the Port St. Lucie Sociat Security Administration Building, subje~t
2 6 to the amended conditions of approval set forth in Part A of this development order.

2 s 4. The project is consistent with the general purpose, goals, objectives, and standards of
2 9 the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development
3 o Code.

32 5. The project will not have an undue adverse effect on adjacent property, the character of
33 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the
34 public health, safety, and general welfare.

36 6. All reasonable steps have been taken to minimize any adverse effect of the proposed
3~ project on the immediate vicinity through building design, site design, landscaping, and
3 s screening.

4 0 7. The project will be constructed, arranged, and operated so as not to interfere with the
41 development and use of neighboring property, in accordance with applicable district
42 regulations.

4 4 8. The project is to be served by adequate public facilities and services.

4 6 9. On November 2, 2009, the applicant was granted a certificate of capacity by the Planning

3 NOW, THEREFORE, BE IT ORDERED:

5 A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the
6 minor adjustment for the project to be known as Port St. Lucie Social Security
~ Administration, is hereby approved for the property described below, subject to the
a following conditions:

io 1. All previous conditions of approval applicable to the subiect propertv, as contained in
ii Development Order GM 09-021 have been consolidated as contained herein. The
ia propertv owner shall complv with all previous conditions of approval and deadlines
i3 qreviouslv established bv Chapter 11 of the Land Development Code and the
14 Development Review Committee, unless expresslv modified herein.

i6 2. Condition A-1 of GM 09-021, has been satisfied.

is Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall
i9 finalize an improvement agreement acceptable to Environmental Resources
ao Department covering the cost of all required landscaping, irrigation, tree mitigation,
ai tree relocation, and related improvements shown in the site plan. A copy of this

26 3. Condition A-2 of GM 09-021, has been satisfied.

a s Prior to issuance of a Vegetation Removal Permit or Exemption, forty (40), two and
a9 one-half (2.5) inch diameter at breast height (DBH) Laurel Oak trees shall be
3 o delivered to the St. Lucie County Jail Nursery.

3a 4. Condition A-3 of GM 09-021, has been satisfied.

34 Prior to issuance of a Vegetation Removal Permit or Exemption, an updated Gopher
35 Tortoise Survey, per Florida Fish and Wildlife Conservation Commission, shall be
36 required.

3 s 5. Condition A-4 of GM 09-021, has been satisfied.

4 o Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall
4 i have obtained and provided Environmental Resources Department with copies of
4a any required federal and state permits, including but not limited to a Florida Fish and
43 Wildlife Conservation Commission Gopher Tortoise Relocation Permit. If federal or
44 state agency compliance requires modification to the development plans, the
45 applicant will promptly modify the plans and submit to SLC for review and approval
46 as required by the LDC. The applicant will not use the County's development
4~ approval to prevent compliance with any federal or state agency requirements.

i 6. Condition A-5 of GM 09-021, is hereby amended.

3 The work referenced in this condition will be completed bv the developers, successor

za Prior to the issuance of a building permit, the petitioner, their successors or assigns
a3 shall have entered into an enforceable utility service agreement with the Port St.
a4 Lucie Utilities Department to ensure the provision of water and sewer services. This

4i successors or assians shall provide Qravitv outfall for the Port St. Lucie Social
4 z Securitv Administration building's storm water svstem to the North Saint Lucie River

45 successors in interest, shall obtain all necessary development permits and construction
46 authorizations from the appropriate State and Federal regulatory authorities including,
4 ~ but not limited to: the United States Army Corps of Engineers, the Florida Department of

i Environmental Protection, and the South Florida Water Management District, prior to the
a issuance of any local building permits of authorizations to commence development
3 activities on the property described in Part B.

s E. The conditions set forth in Part A are an integral nonseverable part of the site plan
6 approval granted by this development order. If any condition set forth in Part A is
~ determined to be invalid or unenforceable for any reason and the developer declines to
s comply voluntarily with that condition, the site plan approval granted by this development
9 order shall become null and void.

ii F. A copy of this Order shall be attached to the site plan drawings described in Part A,
ia which plan shall be placed on file with the St. Lucie County Planning and Development
i3 Services Director and mailed, return receipt requested to the developer and agent of
i4 record as identified on the site plan application.

i6 G. The Certificate of Capacity, Certificate No. 2839, shall be valid for the same period as
i~ this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
is automatically terminate.

ao H. This order shall be recorded in the Public Records of St. Lucie County.
