5 GRANTING APPROVAL FOR A MAJOR ADJUSTMENT TO A MINOR SITE
6 PLAN KNOWN AS SURGICAL SPECIALISTS OF ST. LUCIE COUNTY.

a WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
9 application for major adjustment to a minor site plan approval submitted on behalf of Surgical
io Specialists Real Estate Holdings, LLC and reviewed the comments of the St. Lucie County
11 Development Review Committee on this application, and made the following determinations:

i3 1. On September 8, 2010, the Planning and Development Services Director approved the
i4 petition of Deej Investments, LLC for a Minor Site Plan approval for development of a
is 12,018 square foot outpatient surgical building located approximately'/4 mile south of
i6 Kitterman Road on the east side of US Highway No. 1.

is 2. Surgical Specialist Real Estate Holdings, LLC, is now seeking approval for a major
i9 adjustment to the previously approved minor site plan known as Surgical Specialists of
ao St. Lucie County and amending development PDS Order 10-012.

aa 3. On December 16, 2010, the Development Review Committee reviewed the major
z3 adjustment for the proposed project and found it to be consistent with the previously
a4 approved site plan for the Surgical Specialists of St. Lucie County, subjectto the revised
a5 site plan and amended conditions of approval set forth in Part A of this development
a 6 order.

as 4. The project is consistent with the general purpose, goals, objectives, and standards of
a9 the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development
3 o Code.

3 a 5. The project will not have an undue adverse effect on adjacent property, the character of
33 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting
34 the public health, safety, and general welfare.

36 6. All reasonable steps have been taken to minimize any adverse effect of the proposed
3 ~ project on the immediate vicinity through building design, site design, landscaping, and
3 s screening.

40 7. The project will be constructed, arranged, and operated so as not to interfere with the
4i development and use of neighboring property, in accordance with applicable district
4a regulations.

44 8. The project is to be served by adequate public facilities and services.

46 9. On September 9, 2010, the applicant was granted a certificate of capacity by the

3 NOW, THEREFORE, BE IT ORDERED:

s A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the
6 major adjustment to the minor site plan for the project known as Surgical Specialists of
~ St. Lucie County is hereby approved as shown on the revised site plan dated January
a 21, 2011 and prepared by Captec Engineering, Inc. for the project and date stamped
9 received by the St. Lucie County Planning and Development Services Department on
io January 25, 2010 is being granted for the property described below, subject to the
li following conditions:

i3 1. All previous conditions of approval applicable to the subiect propertv, as contained in
14 Development PDS Order 10-012 have been consolidated as contained herein. The
15 propertv owner shall complv with all previous conditions of approval and deadlines
16 previouslv established bv Chapter 11 of the Land Development Code and the
1~ Development Review Committee, unless exqresslv modified herein.

i9 2. Condition A-1 of PDS Order 10-012, remains:

zi No development permits shall be issued until complete sets of sealed constructible
a a final engineering plans, supporting calculations and survey data for the site work and
z3 offsite improvements are approved by the Office of the County Engineer, Public
a4 Works Department, Utilities Department, Environmental Resources Department,
a5 Planning & Development Services Department, Fire Department, and any other
a 6 agency that may be determined by the Director of Planning & Development Services
a~ to be necessarily involved in the review and approval of the constructible final
a s engineering plans for the site work and offsite improvements. The determination of
z9 whether or not plans submitted by the applicant constitute a complete set of
3 o constructible plans shall be made by the departments involved in the plan review
3i within five business days of the date the plans are received in the Department of
3a Planning & Development Services.

34 3. Condition A-2 of PDS Order 10-012, has been satisfied:

3 6 Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall
3~ submit a revised landscape plan showing the following:
3 a a. A continuous four (4) foot hedge along the eastern property boundary; and
3 9 b. Either a shared driveway/sidewalk adjacent to Lot 2 or a ten (10) foot landscape
4 o strip planted with a four (4) foot tall hedge and one (1) tree per thirty (30) feet
41 between the vehicular use and the adjacent property.

43 4. Condition A-3 of PDS Order 10-012, has been satisfied:

45 Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall
46 provide a fee in lieu to the St Lucie County Tree Mitigation Fund in the amount of
4~ $92,200 for the required tree mitigation.

a 5. Condition A-4 of PDS Order 10-012, remains:

4 Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall
5 finalize an improvement agreement acceptable to Environmental Resources
6 Department covering the cost of all required landscaping, irrigation, tree mitigation,
~ tree relocation, and related improvements shown in the site plan. A copy of this

la 6. Condition A-5 of PDS Order 10-012, has been satisfied:

i4 The applicant will comply with any state and federal agency regulations and
i5 requirements. Prior to issuance of a Vegetation Removal Permit or Exemption, the
i6 applicant shall have obtained and provided Environmental Resources Department
i~ with copies of any required federal and state permits, including but not limited to a
la Florida Fish and Wildlife Conservation Commission Gopher Tortoise Relocation
i9 Permit. If federal or state agency compliance requires modification to the
a o development plans, the applicant will promptly modify the plans and submit to SLC
ai for review and approval as required by the LDC. The applicant will not use the
aa County's development approval to prevent compliance with any federal or state

4i C. The approvals granted by this administrative order shall expire on September 8, 2012
4a unless building permits are issued or an extension is granted in accordance with the
43 provisions of Section 11.02.06 (A) of the St. Lucie County Land Development Code.
44 D. The Final Site Plan approval granted under this order is specifically conditioned to the
45 requirement that the petitioner, Surgical Specialists Real Estate Holdings, LLC, including
46 any successors in interest, shall obtain all necessary development permits and
4 ~ construction authorizations from the appropriate State and Federal regulatory authorities

i including, but not limited to: the United States Army Corps of Engineers, the Florida
a Department of Environmental Protection, and the South Florida Water Management
3 District, prior to the issuance of any local building permits of authorizations to commence
4 development activities on the property described in Part B.

6 E. The conditions set forth in Part A are an integral nonseverable part of the site plan
~ approval granted by this development order. If any condition set forth in Part A is
a determined to be invalid or unenforceable for any reason and the developer declines to
9 comply voluntarily with that condition, the site plan approval granted by this development
io order shall become null and void.

ia F. A copy of this Order shall be attached to the site plan drawings described in Part A,
i3 which plan shall be placed on file with the St. Lucie County Planning and Development
i4 Services Director and mailed, return receipt requested to the developer and agent of
is record as identified on the site plan application.

i~ G. The Certificate of Capacity, Certificate No. 2846, shall be valid for the same period as
ls this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
i9 automatically terminate.

ai H. This order shall be recorded in the Public Records of St. Lucie County.
