TO HAVE AND TO HOLD the same unto the Grantee, its successors and assigned forever.
The 6rantee may remove, cut or trim trees, bushes, and saplings growing upon or extending
over said strip of Innd so fnr as mny be reasonably necessary in the installntion, maintenance,
operation, repnir, replocement, or renewnl of any of the above mentioned improvements.
Subject to the provisions of Section 768.28, FloridQ Stntutes, Grantee agrees to indemnify and
hold harmless Grantor from and against nny actions nt law to recover damages in tort for money
dnmages for injury or loss of property, personal injury, or deuth arising out of the instnllotion,
maintennnce, operation, repair, replacement, or renewal of said fQCilities, and the equipment
connected therewith, over, and across said strip of land and caused by the negligent or wrongful act

or omission of nny employee of Grantee while acting within the scope of his or her office or
employment under circumstnnces in which 6rnntee, if a private person, would be liable to the
claimant, in accordance with the general laws of the State of Floridn.
