LUCIE COUNTY, FLORIDA GRANTING PRELIMINARY PLANNED NON RESIDENTIAL DEVELOPMENT (PNRD) SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS TREASURE COAST RESEARCH AND EDUCATION PARK CORE RESEARCH CAMPUS -PHASE I, CONSISTING OF 154.26 ACRES AND FINAL PNRD SITE PLAN APPROVAL FOR QUAD 1A AND AN AMENDMENT TO THE OFFICIAL ZONING ATLAS FROM THE AR-1, AGRICULTURAL RESIDENTIAL DISTRICT TO PNRD DISTRICT FOR 30.63 ACRES LOCATED AT THE NORTHWEST CORNER OF KINGS HIGHWAY AND PRUITT RESEARCH CENTER ROAD WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: The Treasure Coast Education, Research and Development Authority (TCERDA) has applied for Preliminary Planned Non Residential Development (PNRD) Site Plan approval for the project to be known as Treasure Coast Research and Education Park Core Research Campus -Phase I, consisting of 154.26 acres for the property described in Part C and depicted on the attached map as Exhibit A, and Final PNRD Site Plan approval for Quad 1A and an Amendment to the Official Zoning Atlas from the AR-1 (Agricultural, Residential -1) District to the PNRD (Planned Non Residential Development) District for 30.63 acres for the property described in Part C and depicted on the attached map as Exhibit A. 2. On August 12, 2008, this Board approved the Treasure Coast Education, Research and Development Park (TCRP) Conceptual Master Plan consisting of 1,650 acres. 3. On June 1, 2010, the St. Lucie County Board of County Commissioners entered into an Interlocal Agreement with TCERDA, Fort Pierce Utilities Authority and the City of Fort Pierce regarding water/wastewater service and annexation. 4. On September 28, 2010, the St. Lucie County Board of County Commissioners entered into an Interlocal Agreement with TCERDA and Fort Pierce Utilities Authority regarding utility improvements. 5. On January 20, 2011, the Planning and Zoning Commission held a public hearing on the petition, after publishing a notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve the petition. 6. The Development Review Committee has reviewed the petition and found it to meet the minimum technical requirements of the St. Lucie Land Development Code and to be consistent with the Future Land Use Map from the St. Lucie County Comprehensive Plan. 8. The proposed project is consistent with the general goals, objectives, and standards of review of the St. Lucie Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 9. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 10. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 11. The applicant requested and was granted relief form Section 7.06.01 (F) of the Land Development Code. This relief allows for a one (1) foot reduction in parking stall width and a two (2) foot reduction in drive aisle width. 12. The applicant has applied for and received a Certificate of Capacity for 76,000 square feet of buildings as depicted in Quad IA of the Final PNRD site plan as required under Chapter V, St. Lucie Land Development Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the Preliminary PNRD site plan for the project to be known as Treasure Coast Research and Education Park Core Research Campus -Phase I, consisting of 154.26 acres, is hereby approved as shown on the site plan drawings for the project prepared by Cotleur and Hearing, Inc., dated February, 16, 2011, and date stamped received by the St. Lucie County Planning and Development Services Department on March 9, 2011. B. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the Final PNRD site plan for the proposed project to be known as Treasure Coast Research and Education Park Core Research Campus -Phase I, Quad IA is hereby approved as shown on the site plan drawings for the project prepared by Cotleur and Hearing, Inc., dated February, 16, 2011, and date stamped received by the St. Lucie County Planning and Development Services Department on March 9, 2011 subject to the following conditions: 1. Within 90 days of final site plan approval or prior to issuance of a Vegetation Removal Permit or Exemption, whichever comes first, the applicant shall provide the required Preserve Area Monitoring and Management Plan (PAMP) with an attached affidavit, and a cashier's check, payable to the Clerk of the Court for the appropriate recording fees, to the County Attorney for review and approval. Prior to issuance of a Vegetation and Removal Permit or Exemption, the applicant shall finalize an improvement agreement acceptable to the Environmental Resources Department (ERD) covering the cost to purchase and install all required landscaping, irrigation, tree mitigation, tree relocation, and related improvements shown in the approved landscaping plan. A copy of this agreement can be obtained by visiting the St. Lucie County ERD website at: http://www.stlucieco.org/erd/index.htm. 3. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall have obtained and provided the Environmental Resources Department with copies of any required federal and state permits, including but not limited to US Fish and Wildlife Service (FWS) wood stork mitigation, if applicable. If federal or state agency compliance requires modification to the development plans, the applicant will promptly modify the plans and submit to St. Lucie County for review and approval as required by the Land Development Code. The applicant will not use the County's development approval to prevent compliance with any federal or state agency requirements. 4. The Final PNRD Site Plan for Quad 1A shall require site plan adjustments as per Section 11.02.05 of the St. Lucie County Land Development Code for any modifications to the approved plans. All development in excess of 76,000 s.f. shall require a Certificate of Capacity as per Chapter V, Land Development Code. 5. Prior to any site plan approvals by the County, the TCERDA Board shall review and approve all proposed development for consistency with the Treasure Coast Research Park Design Review Standards manual and the Treasure Coast Education, Research and Development Park (TCRP) Conceptual Master Plan. 6. The applicant has substituted landscaping in lieu of a portion of the paved parking and is noted as reserved for future parking on the site plan. If the County determines that the parking is required per County Land Development Code requirements, a site plan adjustment shall be required and processed to convert the reserved parking spaces to paved parking spaces. 7. Prior to the issuance of a right of way permit, the developer (TCERDA) shall execute a Road Improvement Agreement with St. Lucie County and submit a guarantee of surety for the proposed public improvements. The amount of surety shall be 115% of the engineer's estimate of probable cost. Form of surety shall be approved by the County Attorney. The Agreement shall be approved and signed by the County Administrator or designee. 8. Prior to the issuance of a building permit for Quad 1A, the developer (TCERDA) shall secure the release of the Florida Power and Light easement recorded in Official Record Book 1637, Page 1656. 9. Prior to the issuance of the Road Improvement Agreement, the developer (TCERDA) shall execute an Interlocal Agreement with St. Lucie County Board of County Commissioners. 10. The applicant's surveyor shall notify the County Surveyor when all required survey markers have been set and flagged. 11. Within 90 days after receiving final site plan approval, the applicant shall enter into a Proportionate Fair Share and Impact Fee Credit Agreement for the costs to improve the Kings Highway intersections at Orange Avenue and Angle Road. C. 1. The property on which this Preliminary PNRD site plan approval is being granted is described as follows: LEGAL DESCRIPTION: The Southeast One-Quarter of Section Fourteen (14), Township Thirty-Five (35) South, Range Thirty-Nine (39) East, lying and being in St. Lucie County, Florida. Less and except all road and canal right of ways. Containing 154.26 acres more or less. 2. The property on which this Final PNRD site plan for Quad 1A and amendment to the Official Zoning Atlas from the AR-1 (Agricultural, Residential - 1) District to the PNRD (Planned Non Residential Development) District is being granted is described as follows: LEGAL DESCRIPTION: Being a parcel of land lying in Section 14, Township 35 South, Range 39 East, St. Lucie County, Florida. Said parcel being more particularly described as follows: Commence at the Southeast corner of said Section 14; thence along the South line of said Section 14, South 89°46'45" West, a distance of 86.46 feet; thence departing said South line of said Section 14, North 00°13'15" West, a distance of 70.00 feet to a point on the West right-of-way line of the North St. Lucie River Water Control District Canal No. 40; thence North 00°11'09" West, along said right-of-way line, a distance of 34.50 feet to the Point of Beginning of said parcel; thence South 89°46'45" West, along a line being parallel with, and 104.50 feet North of, as measured at right angles to, the South line of said Section 14, a distance of 1094.23 feet; thence North 45°23'51" West, a distance of 64.84 feet to a point, said point on a line being parallel with, and 132.00 East of, as measured at right angles to, the West line of the Southeast one-quarter of said Section 14; thence North 00°34"50" West, along said line, a distance of 1096.72 feet; thence departing said line, North 44°35'33" East, a distance of 35.25 feet to a point on a line being parallel with, and 66.00 feet South of, as measured at right angles to, the North line of the Southeast one-quarter of said Section 14; thence North 89°45'56" East, along said line, a distance of 1122.98 feet to a point on the West right-of-way line of the North St. Lucie River Water Control District Canal No. 40; thence South 00°11'09" East. The St. Lucie County Planning and Development Services Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Atlas of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this Resolution. E. The approvals and authorizations granted by this Resolution for the purpose of obtaining building permits on this property, shall expire on March 1, 2013, unless the developer has obtained building permits for the final site plan described in Part C or an extension has been granted in accordance with Section 11.02.06, St. Lucie Land Development Code. F. The Preliminary and Final Site Plan approvals granted under this resolution are specifically conditioned to the requirement that the petitioner, TCERDA, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any building permits or authorizations to commence development activities on the property described in Part C. G. A copy of this Resolution shall be attached to the site plan drawings plans and shall be placed on file with the St. Lucie County Planning and Development Services Director. H. The Certificate of Capacity, attached as Exhibit B shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. A copy of this Resolution shall be mailed, returned receipt requested to the developer and agent of record as identified on the petition. This Resolution shall be recorded in the Public Records of St. Lucie County.
