6 A MINOR SITE PLAN TO BE KNOWN AS ROCKINGHAM CARRIAGE
~ SERVICES, INC. ON CERTAIN PROPERTY SITUATED IN ST. LUCIE
a COUNTY, FLORIDA.

io WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
ii application for a minor adjustment to a minor site plan submitted by Culpepper & Terpening, Inc.
ia on behalf of Rockingham Carriage Services, Inc. and reviewed the comments of the
i3 Development Review Committee on this application, and made the following determinations:

15 1. Rockingham Carriage Services, Inc. presented a petition for a Minor Adjustment to a
i6 Minor Site Plan known as AI's Motor Homes for property located at 120 Del Monte
i~ Street in the CG (Commercial General) Zoning District on the property legally described
ia in Part B, consisting of the four following changes:

a o • Change the name of the project to Rockingham Carriage Services, Inc.; and,

az • Provide for the redesignation of the proposed driveway access onto Del Monte
z3 Street (south side of property) from a"Phase I" construction item to a"Future
24 Phase" construction item; and,
25
a 6 • Provide for the reconstruction of the existing North US #1 driveway connection, in
a~ compliance with FDOT design standards; and,
as
a 9 • Provide for a correction to the sites legal description that has been incorrect since
3 o the original approval order was granted by the County 2006.

3a 2. On August 23, 2006, through GM Order 06-025, the St. Lucie County Growth
33 Management Director granted approval of this Minor Site Plan.

35 3. The Development Review Committee reviewed the Minor Adjustment to the Minor Site
36 Plan and found it to meet technical requirements of the Land Development Code and to
3~ be consistent with the St. Lucie County Comprehensive Plan.

39 4. The proposed Minor Adjustment to the Minor Site Plan is consistent with the general
4 o purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan
4i and the St. Lucie County Land Development Code.

43 5. The proposed modification will not have an undue adverse effect on adjacent property,
44 the character of the neighborhood, traffic conditions, parking, utility facilities, or other
4s matters affecting the public health, safety, and general welfare.

i NOW, THEREFORE, BE IT ORDERED:

3 A. Pursuant to Section 11.02.03 (C) of the St. Lucie County Land Development Code, the
4 Minor Adjustment to the Minor Site Plan for the project now to be known as Rockingham
s Carriage Services, Inc. as shown on the site plan (prepared by Culpepper & Terpening,
6 Inc.) for the project date stamped received by the St. Lucie County Planning and
~ Development Services Department on March 3, 2011 is granted, subject to the following
s conditions:

io 1. All previous conditions of approval applicable to the sublect property as found in
ii Development Order GM 06-025 have been consolidated as contained herein.

i3 2. Condition A-1 of GM 06-025 has been satisfied. Condition A-1 of GM 06-025, previously
i4 read as follows.

i6 No clearing or other site work shall commence until after constructible engineering plans
i~ have been approved by the County Engineer and all county environmental permits have
is been issued by Environmental Resources Department pursuant to Section
i9 11.02.08(A)(7) of the St. Lucie County Land Development Code. As of this date of
a o issuance of this Development Order, no constructible site development plans have been
ai submitted for review. No work shall commence after the issuance of environmental
z a permits by county, or of any other permits by any other agency, until the County Engineer
a3 has approved the constructible site plans.

as 3. Condition A-2 of GM 06-025 has been satisfied. Condition A-2 of_GM 06-025,

2 s Pursuant to Section 11.02.08(A)(6) of the St. Lucie County Land Development Code, no
a 9 work shall commence on the site until all regulatory permits required from Federal, State,
3 o and regional agencies and special districts have been issued. The Florida Department
3i of Environmental Protection, National Pollutant Discharge and Elimination System
3 a compliance notice must be submitted to the County Engineer with the constructible site
33 plan at the time of building permit application or during permit review or no paving,
34 grading, and drainage permit and no building permit shall be issued. All National
35 Pollutant Discharge and Elimination System Best Management Practices shall be
3 6 instituted on the site prior to site clearing and maintained daily. Stormwater ponds shall
3~ be roughed in at the same time the site is cleared of groundcover.

39 4. Condition A-3 of GM 06-025 has been satisfied. Condition A-3 of GM 06-025,

4a This Development Order shall be recorded in the Public Records of St. Lucie County,
43 Florida, in order to provide constructive legal notice of development conditions that run

4 3 D. The Minor Adjustment approval granted under this order is specifically conditioned to the
44 requirement that the petitioner, Rockingham Carriage Services, Inc., including any
45 successors in interest, shall obtain all necessary development permits and construction
46 authorizations from the appropriate State and Federal regulatory authorities including,
4~ but not limited to: the United States Army Corps of Engineers, the Florida Department of
4 s Environmental Protection, and the South Florida Water Management District, prior to the

i issuance of any local building permits of authorizations to commence development

4 E. The conditions set forth in Part A are an integral nonseverable part of the minor
s adjustment approval granted by this development order. If any condition set forth in Part
6 A is determined to be invalid or unenforceable for any reason and the developer declines
~ to comply voluntarily with that condition, the site plan approval granted by this
s development order shall become null and void.

io F. A copy of this Order shall be attached to the site plan drawings described in Part A,
ii which plan shall be placed on file with the St. Lucie County Planning and Development
ia Services Director and copies provided to the developer and authorized agent as
i3 identified on the site plan application.

i5 G. This Order shall be recorded in the Public Records of St. Lucie County and a copy of the
i6 recorded Order shall be mailed, return receipt requested to the property owner, and
