HomeMy WebLinkAboutPDS-11-011 - Church of God/Prince of Peace 1 PDS 11-011 2 SPMN 1120104171 3 4 AN ORDER GRANTING APPROVAL FOR A MINOR 5 ADJUSTMENT TO A MINOR SITE PLAN KNOWN AS 6 CHURCH OF GOD/PRINCE OF PEACE ~ 8 9 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the 1o application for a Minor Adjustment to a Minor Site Plan approval submitted by Stephen Cooper, P.E. 11 on behalf of Church of God/Prince of Peace, reviewed the comments of the St. Lucie County 12 Development Review Committee on this application, and made the following determinations: 13 14 1. Church of God/Prince of Peace presented a petition for an addition of 400 square feet to the 15 previously approved 3,100 square foot Sunday school classroom building to allow the total 16 square footage of building to be 3,500 square feet to an existing religious facility on 5.95 17 acres of land for property located at 5905 Oleander Avenue in the RF (Religious Facility) 18 Zoning District, depicted on the attached map as Exhibit "A." 19 20 2. On May 22, 2009, through GM 09-007, the Planning and Development Services Director 21 granted a Major Adjustment to a Minor Site Plan for the project known as Church of 22 God/Prince of Peace, this adjustment allowed the addition of a 3,100 square foot Sunday 23 school classroom building to an existing 12,000 square foot religious facility. 24 25 3. The Development Review Committee has reviewed the Minor Adjustment to a Minor Site 26 Plan for the proposed project and found it to meet the technical requirements of the Land 27 Development Code, subject to the conditions set forth in Part "A" of this Planning and 28 Development Services Order. 29 3 0 4. The project is consistent with the general purpose, goals, objectives, and policies of the St. 31 Lucie County Comprehensive Plan and regulations set forth in the St. Lucie County Land 32 Development Code. 33 34 5. The project will not have an undue adverse effect on adjacent property, the character of the 35 neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public 3 6 health, safety, and general welfare. 37 38 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project 39 on the immediate vicinity through building design, site design, landscaping, and screening. 40 41 7. The project will be constructed, arranged, and operated so as not to interfere with the 42 development and use of neighboring property, in accordance with applicable district 43 regulations. 44 45 8. The project will be served by adequate public facilities and services. 46 47 9. The applicant has received a Certificate of Capacity No. 2873, a copy of which is attached to 48 this order as Exhibit "B," as required under Chapter V, St. Lucie County Land Development 49 Code. 50 JOSEPH E. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed 5 Minor Adjustment to a Minor Site Plan known as Church of God/Prince of Peace, is hereby 6 approved as shown on the site plan drawings for the project, last received by the St. Lucie 7 County Planning and Development Services Director on March 25, 2011, for the property 8 described below, subject to the following conditions: 9 10 1. A Landscape Improvement Agreement with security acceptable to the County Attorney 11 shall be required, prior to issuance of a Vegetation Removal Permit or Exemption. The 12 security shall cover the cost to purchase and install all required landscaping, 13 irrigation, tree mitigation, and related improvements shown on the landscaping 14 plan. A copy of this agreement can be obtained at: 15 http://www.stlucieco.orq/erd/index.htm. 16 17 2. Copies of any required federal and state permits and approvals, if applicable to 18 development, shall be provided to the Environmental Resources Department prior to 19 issuance of a Vegetation Removal Permit or Exemption. If federal or state agency 20 compliance requires modification to the development plans, the applicant will modify the 21 plans and submit to St. Lucie County for review and approval. The County's 22 development approval process or requirements shall not be used to prevent compliance 23 with any federal or state agency requirements. 24 3. The applicant shall provide a revised landscape plan, replacing the proposed Category 1 25 invasive exotic (Ligustrum lucidum) with a native or non-invasive exotic species, prior to 26 issuance of a Vegetation Removal Permit or Exemption (Land Development Code 2 7 Section 7.09.05). 28 4. Prior to the issuance of a Certificate of Occupancy of the proposed addition the applicant 29 shall enter into a"License AgreemenY' with St. Lucie County for the existing sign and 3 o median encroaching into the County road right of way (Oleander Avenue). 31 32 B. The property on which this Minor Adjustment to a Minor Site Plan is being granted is 3 3 described as follows: 34 THE EAST 1/2 OF THE FOLLOWING DESCRIBED PARCEL: 35 36 BEGIN AT THE SW CORNER OF LOT 220, THENCE RUN NORTH 63 FEET; THENCE 37 RUN EASTERLY TO A POINT ON THE EAST LINE OF LOT 220, WHICH IS 52 FEET 38 NORTH OF SAID LOT'S SE CORNER; THENCE RUN SOUTH TO THE SE CORNER OF 39 SAID LOT; THENCE RUN WEST ON THE SOUTH LINE OF SAID LOT 220, TO THE 40 POINT OF BEGINNING; LESS THE EAST 33 FEET FOR ROAD. The approvals granted by this Planning and Development Services Order shall expire on April 7, 5 2013, unless building permits are issued or an extension is granted in accordance with the 6 provisions of Section 11.02.06 of the St. Lucie County Land Development Code. 7 8 D. The Minor Adjustment to a Minor Site Plan approval granted under this Planning and 9 Development Services Order is specifically conditioned to the requirement that the petitioner, 1 o Church of God/Prince of Peace, including any successors in interest, shall obtain all necessary 11 development permits and construction authorizations from the appropriate State and Federal 12 regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the 13 Florida Department of Environmental Protection, and the South Florida Water Management 14 District, prior to the issuance of any local building permits or authorizations to commence 15 development activities on the property described in Part "B." 16 17 E. A copy of this Order shall be attached to the site plan drawings described in Part "A," and shall be 18 placed on file with the St. Lucie County Planning and Development Services Director and copies 19 mailed, return receipt requested to the developer and agent of record as identified on the site plan 2 o applications. 21 22 F. The Certificate of Capacity, attached as Exhibit "B," shall be valid for the same period as this 23 order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically 2 4 term inate. 25 2 6 G. The conditions set forth in Part "A" are an integral non-severable part of the site plan approval as 27 granted by this Order. If any condition set forth in this Order is determined to be invalid or 28 unenforceable for any reason and the developer declines to comply voluntarily with that condition, 2 9 the site plan approval granted by this Order shall become null and void. 30 31 H.
