HomeMy WebLinkAboutPDS-11-004 - Aerex Industries, Inc. ~ PDS No. 11-004 2 File No.: MNSP 820104127 3 4 AN ORDER GRANTING APPROVAL FOR A 5 MINOR SITE PLAN PROJECT TO BE KNOWN AS 6 AEREX INDUSTRIES, INC. 7 8 WHEREAS, the St. Lucie County Planning and Development Services Director has 9 reviewed the application for site plan approval submitted by Sustainable Engineering & 10 Design, Inc., reviewed the comments of the St. Lucie County Development Review 11 Committee on this application, and made the following determinations: 12 13 1. Aerex Industries, Inc. is a proposed 13,000 square foot office industrial use on 1.29 14 acres of property in the IL (Industrial, Light) Zoning District, located at 3416 Industrial 15 27th Street, approximately 250 feet west of North 25th Street, for certain property in St. 16 Lucie County, Florida as described in Part B below. 17 18 2. The Development Review Committee has reviewed the site plan for the proposed 19 project and found it to meet technical requirements of the Land Development Code and 20 to be consistent with the St. Lucie County Comprehensive Plan. 21 22 3. The project will not have an undue adverse effect on adjacent property, the character of 23 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting 24 the public health, safety, and general welfare. 25 26 4. All reasonable steps have been taken to minimize any adverse effect of the proposed 27 project on the immediate vicinity through building design, site design, landscaping, and 28 screening. 29 30 5. The project will be constructed, arranged, and operated so as not to interfere with the 31 development and use of neighboring property, in accordance with applicable district 32 regulations. 33 34 6. The project is to be served by Fort Pierce Utilities Authority water and wastewater 35 services. 36 37 7. The applicant has applied for and received a Certificate of Capacity, a copy of which is 38 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land 39 Development Code. 40 May 4, 2011 File No.: MNSP 820104127 Page 1 PDS No. 11-004 JOSEPH E. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the 4 proposed Minor Site Plan to be known as Aerex Industries Office, is hereby approved 5 as shown on the site plan drawings for the project prepared by Sustainable Engineering 6 & Design Inc., dated April 22, 2011, revised through April 20, 2011, and date stamped 7 received by the St. Lucie County Planning and Development Services Department on 8 April 22, 2011, subject to the following conditions: 9 10 1. The applicant shall execute an agreement to pay a fee-in-lieu of construction for the 11 concrete sidewalk and remit to the County the required funds within 90 days after 12 receiving site plan approval. The acceptable method of payment shall be a certified 13 check payable to St. Lucie County. 14 2. Copies of any required federal and state permits and approvals, if applicable to the 15 proposed action, shall be provided to the Environmental Resources Department 16 prior to issuance of a Vegetation Removal Permit or Exemption. If federal or state 17 agency compliance requires modification to the development plans, the applicant will 18 modify the plans and submit to St. Lucie County for review and approval. The 19 County's development approval process or requirements shall not be used to 20 prevent compliance with any federal or state agency requirements. 21 22 B. The property on which this Minor Site Plan approval is being granted is described as 23 follows: 24 25 A PARCEL OF LAND BEING KNOWN AS LOT 4 OF A REPLAT OF LOTS 2 26 THRU 19 OF BLOCK 6"AIRPORT INDUSTRIAL PARK" UNIT ONE, AS 27 RECORDED IN PLAT BOOK 20, PAGE 10, OF THE PUBLIC RECORD OF 28 SAINT LUCIE COUNTY, FLORIDA 29 30 Location: Industrial 27t" Street, Fort Pierce, FL 31 Parcel ID No.1429-502-0004-0009 32 33 C. The approvals granted by this administrative order shall expire on May 4, 2013, unless 34 an extension is granted in accordance with the provisions of Section 11.02.06 of the St. 35 Lucie County Land Development Code. 36 37 D. The Final Site Plan approval granted under this Order is specifically conditioned to the 38 requirement that the property owners, successor and assigns in interest, shall obtain all 39 necessary development permits and construction authorizations from the appropriate 40 State and Federal regulatory authorities including, but not limited to; the United States 41 Army Corps of Engineers, the Florida Department of Environmental Protection, and the 42 South Florida Water Management District, prior to the issuance of any local building May 4, 2011 File No.: MNSP 820104127 Page 2 PDS No. 11-004 1 permits of authorizations to commence development activities on the property 2 described in Part A. 3 4 E. This Order shall become effective upon the date of approval indicated below. Should 5 the property owner, developer or authorized agent wish to appeal any condition 6 described in Part A above, all such appeals must be filed in writing with the County 7 Administrator within 30 days of the rendering of this Order, as described in Section 8 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this 9 Order be filed, no permitting reviews or further administrative action shall take place on 10 the processing of this development project until the appeal is resolved. 11 12 F. A copy of this Order shall be attached to the site plan drawings described in Part A, 13 which plan shall be placed on file with the St. Lucie County Planning and Development 14 Services Director and mailed, return receipt requested to the developer and agent of 15 record as identified on the site plan applications. 16 17 G. The conditions set forth in Part A are an integral nonseverable part of the site plan 18 approval granted by this Order. If any condition set forth in Section A is determined to 19 be invalid or unenforceable for any reason and the developer declines to comply 20 voluntarily with that condition, the site plan approval granted by this order shall become 21 null and void. 22 23 H. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as 24 this order. If this order expires or otherwise terminates, the Certificate of Capacity shall 25 automatically terminate. 26 27 I.
