4 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
5 ST. LUCIE COUNTY, FL GRANTING APPROVAL FOR A CLASS A
6 MOBILE HOME PERMIT FOR PROPERTY LOCATED IN ST. LUCIE
7 COUNTY, FORIDA.

9 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
to testimony and evidence including, but not limited to the staff report, has made the following
11 determinations:

13 1. Aimee I. Cablish and Eric J. Townsend petitioned for a Class A Mobile Home Permit
14 for property located at 13599 C-24 Canal Road, Port St. Lucie, FL described in
15 Paragraph "B" and depicted on the attached map as Exhibit "A".

17 2. On July 5, 2011, this Board held a public hearing on the petition, after publishing notice
18 at least 10 days prior to the hearing and notifying by mail all owners of property within
19 500 feet of the subject property.

21 3. The proposed mobile home is not in conflict with the goals, objectives, and policies of
22 the St. Lucie County Comprehensive Plan and, with conditions, will satisfy the
23 requirements of Section 11.05.02, Class A Mobile Home Permits, of the St. Lucie Land
24 Development Code.

26 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
27 County, Florida:

29 A. The Class A Mobile Home Permit for the property owned by Aimee I. Cablish and Eric J.
3o Townsend and described in Paragraph " B" is hereby approved with the following
31 condition(s):

33 1. Prior to placement of the mobile home on the subject property, the property owner
34 shall obtain an approved building permit and comply with St. Lucie County Land
35 Development Code requirements and shall obtain all applicable state and federal
36 permits.

38 2. The property owner shall meet the minimum roof pitch requirement stated in Section
39 11.05.02.D, St. Lucie Land Development Code, by complying with one of the
q o following:

4 2 a. Prior to the issuance of a certificate of occupancy for the mobile home on the
4 3 subject property, the roof of the mobile home shall be modified, or
4 q b. Prior to the issuance of a building permit for the mobile home, the property owner
4 5 shall obtain a Variance from the Board of Adjustment for this dimensional
q 6 requirement.

1 3. Copies of any required federal and state permits and approval, if applicable to
2 development, shall be provided to the Environmental Resources Department prior to
3 issuance of a Vegetation Removal Permit or Exemption. If federal or state agency
4 compliance requires modifications to the development plans, the applicant will modify
5 the plans and submit to St. Lucie County for review and approval. The County's
6 development approval process or requirements shall not be used to prevent
~ compliance with any federal or state agency requirements.

9 4. If trees, wetlands, or wetland buffers will be impacted, the applicant shall provide the
1 o Environmental Resources Department with a tree survey, identifying all trees of four
11 inches diameter or greater and other natural features of unique or significant
12 character (including wetlands) within 50 feet of the proposed mobile home prior to
13 issuance of a Vegetation Removal Permit or Exemption (Land Development Code
14 Sections 11.05.02.8.12 and 11.05.06).

16 5. The applicant shall be required to meet the landscape requirements of the Land
1~ Development Code Section 7.09.04.1 prior to a Certificate of Occupancy.

19 6. If any impacts to wetlands or County-required wetland buffers are proposed, the
20 applicant will be required to demonstrate that the avoidance/minimization criteria of
21 Comprehensive Plan Policies 6.1.14.2 through 6.1.14.8 have been met and any
22 necessary waivers have been granted by the Board of County Commissioners, prior
23 to issuance of a Vegetation Removal Permit or Exemption.

25 7. If any impacts to County-protected trees are proposed, a tree mitigation plan shall be
2 6 provided (Land Development Code Sections 11.05.06 and 6.00.05) prior to issuance
27 of a Vegetation Removal Permit or Exemption. Tree mitigation requirements, if any
28 shall be addressed prior to issuance of a Certificate of Occupancy.

3o B. The property on which this Class A Mobile Home Permit is being granted is described as
31 follows:

33 A parcel of land situate in Section 20, Township 36 South, Range 39 East, St. Lucie
34 County, Florida, bounded and described as follows:

36 Beginning at the intersection point of the Southwesterly right-of-way line of the C-24
3~ Diversion canal, and a line 438.4 feet East of (as measured perpendicularly) the West
38 line of said Section 20, said line being parallel to the West line of Section 20; said
39 intersection point being represented by the intersection of old fence lines; Thence run
4 o South 01°00'00" West along an old fence line, said fence line being the previously
41 described parallel line, for a distance of 705.67 feet; Thence run South 89°00'00" East
4 2 for a distance of 105.00 feet; Thence run North 01°00'00" East for a distance of 589.60
4 3 feet to an old fence line, said fence line being the previously described canal right-of-way
4 4 line; Thence run North 41°08'00" West along lastly described old fence line for a
45 distance of 156.52 feet to the Point of Beginning. Containing 1.56 acres.

C. A copy of this Resolution shall be mailed, return receipt requested, to the owner of
record as identified in the application.
D. This Resolution shall be recorded in the Public Records.
