LUCIE COUNTY INTERNATIONAL AIRPORT TO 8 EXPAND THE TERMINAL AND CUSTOMS BUILDINGS 9 10 11 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the 12 application for a minor adjustment to an existing conditional use submitted by the St. Lucie 13 County International Airport and reviewed the comments of the St. Lucie County Development 14 Review Committee on this application, and has made the following determinations: 15 16 1. The St. Lucie County International Airport has proposed expansion of the existing 17 terminal and customs buildings from 11,279 total square feet to 18,039 total square feet 18 resulting in an additional 6,760 gross square feet of building area affecting 3.77 of the 19 airport's 219 total acres located at 3000 Curtis King Boulevard. 20 21 2. On July 21, 2011, the Development Review Committee reviewed the minor adjustment to 22 an existing conditional use for the proposed project and found it to meet the technical 23 requirements of the Land Development Code and be consistent with the St. Lucie County 24 Comprehensive Plan. 25 26 3. On August 12, 2011 the Planning and Development Services Director reviewed and 27 granted the applicant's request for a minor adjustment to the existing conditional use. 28 29 4. The project is consistent with the general purpose, goals, objectives, and policies of the 3 o St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 31 32 5. The project will not have an undue adverse effect on adjacent property, the character of 33 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the 34 public health, safety, and general welfare. 35 36 6. All reasonable steps have been taken to minimize any adverse effect of the proposed 37 project on the immediate vicinity through building design, site design, landscaping, and 3 8 screening. 39 4 0 7. The project will be constructed, arranged, and operated so as not to interfere with the 41 development and use of neighboring property, in accordance with applicable district 42 regulations. 43 44 8. The applicant has applied for and received a Certificate of Capacity Exemption, a copy of 2 which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie 3 County Land Development Code. 4 5 NOW, THEREFORE, BE IT ORDERED: 6 ~ A. Pursuant to Section 11.07.05 E. of the St. Lucie County Land Development Code, s the minor adjustment to an existing conditional use for the project to be known as St. 9 Lucie International Airport Terminal Expansion, is hereby approved as shown on 1o the site plan (dated June 29, 2011 -prepared by the LPA Group Inc.) and the 11 landscape plan (dated June 29, 2011 -prepared by Sabine Marcks) for the project 12 date stamped received by the St. Lucie County Planning and Development Services 13 Department on August 4, 2011 is being granted for the property described below, 14 subject to the following condition: 15 16 1. Copies of any required federal and state permits and approvals, if applicable to 17 development, including, but not limited to US Fish and Wildlife Service is approval/authorization, shall be provided to the Environmental Resources 19 .Department prior to issuance of a Vegetation Removal Permit or Exemption. If a o federal or state agency compliance requires modification to the development 21 plans, the applicant will modify the plans and submit to St. Lucie County for as review and approval. The County's development approval process or 23 requirements shall not be used to prevent compliance with any federal or state 24 agency requirements. 25 z 6 B. The Final Site Plan approval granted under this order is specifically conditioned to the 29 requirement that the petitioner, St. Lucie County International Airport, including any 3 o successors in interest, shall obtain all necessary development permits and construction 31 authorizations from the appropriate State and Federal regulatory authorities including, 32 but not limited to: the United States Army Corps of Engineers, the Florida Department of 33 Environmental Protection, and the South Florida Water Management District, prior to the 34 issuance of any local building permits or authorizations to commence development 35 activities on the property described in Part B. 36 37 E. The conditions set forth in Part A are an integral nonseverable part of the site plan 3 s approval granted by this Order. If any condition set forth in Part A is determined to be 3 9 invalid or unenforceable for any reason and the developer declines to comply voluntarily 4o with that condition, the site plan approval granted by this Order shall become null and 41 VOId. 42 43 F.
