HomeMy WebLinkAboutGM-06-025 - Al's Motor Homes1 2 3 4 5 6 GM-06-025 File No.: MNSP-OS-014 AN ORDER GRANTING MINOR SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS AL'S MOTOR HOMES WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan approval submitted by Stephen Cooper, reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. AI's Motor Homes is a proposed RV sales facility consisting of 4,000 square foot service building, a 1,462 square foot sales addition, and a 1,102 square foot customer lounge for a total of 6,564 square feet of space, for property located at the southwest corner of the intersection of Indrio Road and North U. S. Highway No. 1, in the CG (Commercial General) Zoning District. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit "A", as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03(A)(5) of the St. Lucie County Land Development Code, the Final Site Plan for the project to be known as AI's Motor Homes, and the same is hereby, approved as shown on the site plan drawings for the project prepared by Stephen Cooper, P.E. & Associates, Inc., on May 17, 2006, and last revised on September 13, 2005, and received by the St. Lucie County Growth Management Director on September 30, 2005, is being granted for the property described below, subject to the following conditions: No clearing or other site work shall commence until after constructible engineering plans have been approved by the County Engineer and all county environmental permits have been issued by Environmental Resources Department pursuant to Section 11.02.08(A)(7) of the St. Lucie County Land Development Code. As of this date of issuance of this Development Order, no constructible site development plans have been submitted for review. No work shall commence after the issuance of environmental permits by county, or of any other permits by any other agency, until the County Engineer has approved the constructible site plans. 2. Pursuant to Section 11.02.08(A)(6) of the St. Lucie County Land Development Code, no work shall commence on the site until all regulatory permits required from Federal, State, and regional agencies and special districts have been issued. The Florida Department of Environmental Protection, National Pollutant Discharge and Elimination System compliance notice must be submitted to the County Engineer with the constructible site plan at the time of building permit application or during permit review or no paving, grading, and drainage permit and no building permit shall be issued. All National Pollutant Discharge and Elimination System Best Management Practices shall be instituted on the site prior to site clearing and maintained daily. Stormwater ponds shall be roughed in at the same time the site is cleared of groundcover. 3. This Development Order shall be recorded in the Public Records of St. Lucie County, Florida, in order to provide constructive legal notice of development conditions that run with the land. 4. The Code Compliance Manager shall receive a copy of this Development Order and the site plan it approves and shall not approve any building permits that do not implement or are not consistent with this Development Order and the plans hereby approved. 5. The developer, his successors or assigns shall either construct or, in accordance with Section 11.04.00 of the St. Lucie County Land Development Code, provide sufficient security for the construction of that unpaved portion of Del Monte Street adjacent to the subject property. As part of the Site Plan approval for the project, the petitioner, his successors or assigns, shall convey to St. Lucie County 33.75 feet of additional right-of-way for Indrio Road. B. The property on which the minor site plan is being approved is described as follows: PLAT OF INDRIO-UNIT 1-BLK 22 LOTS 4 , 5 AND 6 AND THAT PART OF CRESTLINE DR ADJ ONE (OR :1270-2960) and PLAT OF INDRIO-UNIT 1-BLK 22 LOTS 7, 8, 9 AND 10-LESS RD R/W- (OR 2075-1538) ST. LUCIE COUNTY, FLORIDA. (Tax ID No.: 1416-601-0110-000/9, 1416-601-0113-000/0) (Location: Southwest corner of the intersection of Indrio Road and U. S. Highway No. 1) C. This site plan shall expire on August 23, 2008, unless a building permit is issued or a site plan approval extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. D. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, AI's Motor Homes, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Section A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(6), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. The certificate of exemption, attached as Exhibit A, shall be valid for the same period as this order.
