5 A RESOLUTION APPROVING A VARIANCE FOR
6 CERTAIN PROPERTY LOCATED AT 101 NE PRIMA VISTA BLVD
7 IN ST. LUCIE COUNTY, FLORIDA .

9 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and
10 evidence, including, but not limited to the staff report, has made the following determinations:
11
12 1. Petition of AutoZone Primavista for a variance from the provisions of Section 7.05.06
13 (2)(c), St. Lucie County Land Development Code, which requires all driveways to comply
14 with a 25 foot setback from the property line for a site located at the intersection of
15 Airoso Boulevard and Prima Vista Boulevard in the CO (Commercial-Office) Zoning
16 District.

18 2. On September 28, 2011, this Board held a public hearing on the petition, after publishing
19 a notice of such hearing, installing a sign on property and notifying by mail all owners of
20 property within 500 feet of the subject property.

22 3. After consideration of the testimony presented during the public hearing, including staff
23 comments, exhibits, and the standards of review for granting variances set out in Section
24 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made
25 the following determinations:

27 The requested variance has met the standards of revrew as set forth in Section
28 10.01.02, St. Lucie County Land Development Code, and is not in conflict with the goals,
29 objectives, and policies of the St. Lucie County Comprehensive Plan, because

31 A. The grantrng of the requested variance would not impair or otherwise injure adjacent
32 residential property owners or improvements in the area in which the subject
33 property is located because it abuts a 100 foot wide canal.
34
35 8. The granting of the requested variance allows for the development of a driveway to
36 serve the proposed development on the subject property and ensure proper
37 vehicular circulation on site as well as ingress and egress.

39 C. The requested variance meets the general spirit and rntent of the St. Lucie County
40 Land Development Code and the St. Lucie County Comprehensive Plan.

42 NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
43 Florida:

11 B. Based on the evidence presented, this variance request is approved. An appeal of the
12 Board of AdjustmenYs action may be processed in accordance with Section 10.01.07 of
13 the St. Lucie County Land Development Code.

15 C. This variance shall expire twelve months from the date of adoption unless a building
16 permit is approved or an extension is granted in accordance with Section 10.01.06 of the
17 St. Lucie County Land Development Code.
