5 DIRECTOR GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO
6 A MAJOR SITE PLAN TO BE KNOWN AS FAUX EFFECTS ON
~ CERTAIN PROPERTY SITUATED IN ST. LUCIE COUNTY, FLORIDA.

9 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
io application for a minor adjustment to a major site plan submitted by MBV Engineering, Inc. on
il behalf of Raymond Sandor and reviewed the comments ofthe Development Review Committee
ia on this application, and made the following determinations:

i4 1. Raymond Sandor presented a petition for a Minor Adjustment to a Major Site Plan
is previously known as Harpetco for property located at 2700 Industrial Avenue 2, Fort
i6 Pierce in the IL (Industrial, Light) Zoning District on the property legally described in
i~ Part B, consisting of the following changes: •

i9 • Change the name of the project to Faux Effects; and,

2i • Provide for the removal of existing septic/drainfield and installation of new private
aa lift station and force main; and,

a4 • Provide for the clarification of propose uses within the existing building to assure
as that all on-site parking and loading facilities is in compliance with the provisions of
a 6 the Code.

a s 2. The Development Review Committee reviewed the Minor Adjustment to the Minor Site
a 9 Plan and found it to meet technical requirements of the Land Development Code and to
3 o be consistent with the St. Lucie County Comprehensive Plan.

3 z 3. The proposed Minor Adjustment to the Minor Site Plan is consistent with the general
33 purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan
34 and the St. Lucie County Land Development Code.

36 4. The proposed modification will not have an undue adverse effect on adjacent property,
3 ~ the character of the neighborhood, traffic conditions, parking, utility facilities, or other
3 a matters affecting the public health, safety, and general welfare.

4o NOW, THEREFORE, BE IT ORDERED:

4a A. Pursuant to Section 11.02.04 (C) of the St. Lucie County Land Development Code, the
43 Minor Adjustment to the Major Site Plan for the project now to be known as Faux Effects
44 as shown on the site plan (prepared by MBV Engineering) for the project date stamped
45 received by the St. Lucie County Planning and Development Services Department on
46 September 26, 2011 is granted, subject to the following conditions:

i 1) Within 90 days of site plan adjustment approval, the applicant shali conduct an on-
a site meeting with staff from the Environmental Resources Department, to evaluate
3 the existing landscaping relative to the December 1988 approved plans. If
4 landscape deficiencies are noted, the applicant shall bring the site's landscaping into
s compliance within 60 days from the date the County notifies the applicant of any
6 landscaping deficiencies (Land Development Code Section 7.09.03.D.1).
~ 2) All exterior site work shall be conducted outside of the Florida scrub-jay nesting
s season (March 1 through June 30).
9 3) Gopher tortoise educational materials shall be provided to construction personnel
io and posted on-site, prior to issuance of a Vegetation Removal Permit/Exemption.
ii 4) Vegetation protection measures, including directional boring under any affected
ia critical root zone areas, will be required as a condition of the Vegetation Removal
13 Permit/Exemption (Land Development Code Section 6.00.05.C).

i5 B. The property on which this Minor Adjustment to Major Site Plan is being granted is

a a C. The approvals granted by this administrative order shall expire on September 26, 2013
a 3 unless permits are issued or an extension is granted in accordance with the provisions of
24 Section 11.02.06 of the St. Lucie County Land Development Code.
a s D. The Minor Adjustment approval granted under this order is specificalty conditioned to the
a6 requirement that the petitioner, Raymond Sandor, including any successors in interest,
a ~ shall obtain all necessary development permits and construction authorizations from the
a a appropriate State and Federal regulatory authorities including, but not limited to: the
a9 United States Army Corps of Engineers, the Florida Department of Environmental
3 o Protection, and the South Florida Water Management District, prior to the issuance of
31 any local building permits of authorizations to commence development activities on the
3a property described in Part B.

34 E. The conditions set forth in Part A are an integral nonseverable part of the minor
35 adjustment approval granted by this development order. If any condition set forth in Part
3 6 A is determined to be invalid or unenforceable for any reason and the developer declines
3~ to comply voluntarily with that condition, the site plan approval granted by this
3 e development order shall become null and void.

4o F. A copy of this Order shall be attached to the site plan drawings described in Part A,
4i which plan shall be placed on file with the St. Lucie County Planning and Development
42 Services Director and copies provided to the developer and authorized agent as
43 identified on the site plan application.

45 G. This Order shall be recorded in the Public Records of St. Lucie County and a copy of the

i recorded Order shall be mailed, return receipt requested to the property owner, and
a authorized agent as indentified on the site plan applications.
