4 AN ORDER GRANTING MINOR SITE PLAN
5 APPROVAL FOR A PROJECT TO BE KNOWN AS
6 COASTAL FLOOR AND GRANITE

8 WHEREAS, the St. Lucie County Planning & Development Services Director has reviewed
9 the application for site plan approval submitted by Friscia Engineering, reviewed the
10 comments of the St. Lucie County Development Review Committee on this application, and
11 made the following determinations:

13 1. Coastal Floor and Granite is a proposed 8,465 square foot retail building on 1.25
14 acres of property in the CG (Commercial, General) Zoning District, located on the east
15 side of U.S. Highway 1, approximately 700 feet north of Savannah Club Road, for
16 certain property in St. Lucie County, Florida as described in Part B below.

18 2. The Development Review Committee has reviewed the site plan for the proposed
19 project and found it to meet technical requirements of the Land Development Code and
20 to be consistent with the St. Lucie County Comprehensive Plan.

22 3. The project will not have an undue adverse effect on adjacent property, the character of
23 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting
24 the public health, safety, and general welfare.

26 4. All reasonable steps have been taken to minimize any adverse effect of the proposed
27 project on the immediate vicinity through building design, site design, landscaping, and
28 screening.

30 5. The project will be constructed, arranged, and operated so as not to interfere with the
31 development and use of neighboring property, in accordance with applicable district
32 regulations.

34 6. The project is to be served water and wastewater service by the Port St. Lucie Utility
35 Systems Department.

37 7. The applicant has applied for and received a Certificate of Capacity, a copy of which is
38 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land
39 Development Code.

1 NOW, THEREFORE, BE IT ORDERED:

3 A. Pursuant to Section 11.02.0~4 of the St. Lucie County Land Development Code, the
4 proposed Minor Site Plan to~ be known as Coastal Floor and Granite, is hereby
5 approved as shown on the site plan drawings for the project prepared by Friscia
6 Engineering, dated NovembE~r 18, 2010, revised through July 13, 2011, and date
7 stamped received by the :it. Lucie County Planning & Development Services
8 Department on August 23, 2C?11, 2011, subject to the following conditions:

10 1. Prior to the issuance of ~~ny construction authorizations a recorded copy of the
11 easement agreement for the finrenty-six foot wide (26') ingress and egress easement
12 shown on the site plan sh,~ll be submitted and approved by the County Surveyor.
13 2. Prior to the issuance of a building permit, the Planning & Development Services
14 Director must review and ~ipprove the proposed signage documents for consistency
15 with Land Development Code Section 7.10.24.1.
16 3. Copies of any required fe:deral and state permits and approvals, if applicable to
17 development, shall be prowided to the Environmental Resources Department prior to
18 issuance of a Vegetation I~emoval Permit or Exemption. If federal or state agency
19 compliance requires modil~ication to the development plans, the applicant will modify
20 the plans and submit to ~~t. Lucie County for review and approval. The County's
21 development approval process or requirements shall not be used to prevent
22 compliance with any federal or state agency requirements.
23 4. Cutting and fabrication of caranite countertops shall be allowed as an incidental use
24 to the on-site retail sales, :~ubject to all applicable permitting requirements and the
25 following conditions:
26 a. The fabrication of granite is limited to a maximum of 80~ square feet of building
27 floor area.
28 b. The outdoor storage, ~~reparation, cutting or fabrication of granite is prohibited.
29 c. Hours of granite fabric;ation are limited to 8am until 5pm. Complaints of any
30 undesirable noise, vibration, dust or other undesirable effects may result in this
31 incidental use being rewoked. No other fabrication or manufacturing is permitted
32 on the site.

34 B. The property on which this Minor Site Plan approval is being granted is described as

21 C. The approvals granted by this administrative order shall expire on September 1, 2013,
22 unless an extension is granted in accordance with the provisions of Section 11.02.06 of
23 the St. Lucie County Land Development Code. The Certificate of Capacity, attached as
24 Exhibit A, shall be valid for the same period as this order. If this order expires or
25 otherwise terminates, the Certificate of Capacity shall automatically terminate.

27 D. The Final Site Plan approval granted under this Order is specifically conditioned to the
28 requirement that the property owners, successor and assigns in interest, shall obtain all
29 necessary development permits and construction authorizations from the appropriate
30 State and Federal regulatory authorities including, but not limited to; the United States
31 Army Corps of Engineers, the Florida Department of Environmental Protection, and the
32 South Florida Water Management District, prior to the issuance of any local building
33 permits of authorizations to commence development activities on the property
34 described in Part A.

36 E. This Order shall become effective upon the date of approval indicated below. Should
37 the property owner, developer or authorized agent wish to appeal any condition
38 described in Part A above, all such appeals must be filed in writing with the County
39 Administrator within 30 days of the rendering of this Order, as described in Section
40 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this
41 Order be filed, no permitting reviews or further administrative action shall take place on

1 the processing of this development project until the appeal is resolved.

3 F. The conditions set forth in Part A are an integral nonseverable part of the site plan
4 approval granted by this Orde~r. If any condition set forth in Section A is determined to
5 be invalid or unenforceable for any reason and the developer declines to comply
6 voluntarily with that condition, the site plan approval granted by this order shall become
7 null and void.

9 G. A copy of this Order shall be attached to the site plan drawings described in Part A,
10 which plan shall be placed ori file with the St. Lucie County Planning & Development
11 Services Director and mailed to the developer and agent of record as identified on the
12 site plan applications.

14 H. This order shall be recorded in the Public Records of St. Lucie County.
15
16 ORDER effective the 1 st Day of September, 2011.
