1 o WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan

2 6 neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public
2 ~ health, safety, and general welfare.

3o the immediate vicinity through building design, site design, landscaping, and screening.

32 6. The project will be constructed, arranged, and operated so as not to interfere with the
33 development and use of neighboring property, in accordance with applicable district regulations.

1. Prior to the issuance of a Vegetation Removal Permit, the Florida Fish and Wildlife
Conservation Commission, pursuant to the requirements of Rules 68A-25.002 and
68A-27.005 of the Wildlife Code of the State of Florida, shall review the
development plans and verify that state setback guidelines can be met from the
gopher tortoise burrows found on site or determine if a relocation/release permit
is required. The Environmental Resources Division will not support an application
for a take permit. All gopher tortoise burrows found on the site shall be clearly
marked.

2. Prior to the issuance of a Vegetation Removal Permit, the applicant will meet with
Environmental Resources Division staff on site to discuss placement of the
proposed home and any accessory structures to minimize the impacts to the on
site natural resources. Mitigation will be required for impacts to native trees in
accordance with the latest approved version of Section 6.00.00 of the St. Lucie
County Land Development Code. All native trees that are to be preserved on site
shall be protected with a conspicuous, durable protective barrier approved by the
Environmental Resources Division.
3. All category I invasive exotic plant species shall be removed from the site after
obtaining a vegetation removal permit from the Environmental Resources
Division.

C. The approvals granted by this administrative order shall expire on August 5, 2007, unless a
building permit is issued or an extension is granted in accordance with the provisions of Section
11.02.06 of the St. Lucie County Land Development Code.
D. The Final Site Plan approval granted under this Resolution is specifically conditioned to the
requirement that the petitioner, Frank Silva, including any successors in interest, shall obtain all
necessary development permits and construction authorizations from the appropriate State and
Federal regulatory authorities including, but not limited to; the United States Army Corps of
Engineers, the Florida Department of Environmental Protection, and the South Florida Water
Management District, prior to the issuance of any local building permits of authorizations to
commence development activities on the property described in Part A.
E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan
shall be placed on file with the St. Lucie County Growth Management Director and mailed, return
receipt requested to the developer and agent of record as identified on the site plan applications.
F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order.
If this order expires or otherwise terminates, the Certificate of Capacity shall automatically
terminate.
G. This order shall be recorded in the Public Records of St. Lucie County.
