AN ORDER GRANTING MINOR SITE PLAN
APPROVAL TO AN EXISTING DEVELOPMENT
KNOWN AS THE TREASURE COAST FOOD BANK
WHEREAS, the St. Lucie County Planning and Development Services Director has
reviewed the application for site plan approval and reviewed the comments of the St. Lucie
County Development Review Committee on this application, and made the following
determinations:
Treasure Coast Food Bank project is a 11,970 square foot addition to an existing
9,350 square foot building on 2.1 acres of property in the IL (Industrial, Light) Zoning
District, located at 3051 Industrial 25th Street in St. Lucie County, Florida for the
property described in Part B below.
2. The Development Review Committee has reviewed the site plan for the proposed
project and found it to meet technical requirements of the Land Development Code and
to be consistent with the St. Lucie County Comprehensive Plan.
3. The project will not have an undue adverse effect on adjacent property, the character of
the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting
the public health, safety, and general welfare.
4. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
5. The project will be constructed, arranged, and operated so as not to interfere with the
development and use of neighboring property, in accordance with applicable district
regulations.
6. The project is to be served by adequate public facilities and services.
7. The applicant has applied for and received a Certificate of Capacity, a copy of which is
attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land
Development Code.

NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the
proposed Minor Site Plan project to be known as Treasure Coast Food Bank, is
hereby approved as shown on the site plan drawings for the project prepared by Friscia
Engineering, dated September 30, 2010, revised through October 26, 2011, and date
stamped received by the St. Lucie County Planning and Development Services Director
on November 1, 2011, subject to the following conditions:
1. All vegetation clearing and construction activities shall be conducted outside of
the scrub-jay nesting season (March 1 through June 30).
2. Priorto issuance of a Vegetation Removal Permit or Exemption, gophertortoise
educational materials shall be provided to construction personnel and posted on-
site.
3. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant
shall have obtained and provided the Environmental Resources Department with
copies of any required federal and state permits, including, but not limited to a
gopher tortoise relocation permit. If federal or state agency compliance requires
modification to the development plans, the applicant will promptly modify the
plans and submit to St. Lucie County for review and approval as required by the
Land Development Code. The applicant will not use the County's development
approval to prevent compliance with any federal or state agency requirements.
4. Prior to issuance of a Vegetation Removal Permit or Exemption, if more than
one year or nesting season has elapsed since the most recent listed species
surveys were conducted in accordance with appropriate state and/or federal
protocols, updated surveys shall be required for the gopher tortoise and Florida
scrub-jay, as well as any other listed species for which the state or federal
government have required updated surveys. Surveys should be conducted in
accordance with appropriate state and/or federal protocols, and documentation
of survey methods and results shall be provided to the Environmental Resources
Department, as well as the appropriate state and/or federal agencies. In the
event that the applicant obtains written documentation from the US Fish and
Wildlife Service for federally-listed species or the Florida Fish and Wildlife
Conservation Commission for state-listed species, indicating that updated
surveys will not be required for this project, this condition of approval will be
considered addressed.
5. No construction authorizations shall be issued until a complete set of
constructible final engineering plans are approved by the Office of the County
Engineer.
6. Prior to the issuance of the first Certificate of Occupancy (CO), the developer
shall provide a concrete sidewalk, having a minimum width of five (5') feet, along

7. The developer shall execute a Road Improvement Agreement (Agreement) with
St. Lucie County and submit a surety for the proposed public improvements. The
amount of surety shall be 115% of the engineer's estimate of probable cost.
Form of surety shall be approved by the County Attorney. A St. Lucie County
right of way permit shall not be issued until the St. Lucie County Board of County
Commissioners has approved the Agreement.
8. Forty-five days prior to the commencement of construction for the proposed
public improvements the developer's engineer shall submit detailed construction
plans for review and approval by the County Engineer.
9. Prior to issuance of a building permit architectural elevations shall be submitted
for review and determination of compliance with the Airport Industrial Park -
Special regulations, Section 7.10.18(D)4) of the St. Lucie County Land
Development Code. The plans shall include the identification of all exterior
coverings and colors.
B. The property on which this Minor Site Plan approval is being granted is described as
follows:

C. The approvals granted by this administrative order shall expire on December 2, 2013,
unless an extension is granted in accordance with the provisions of Section 11.02.06 of
the St. Lucie County Land Development Code.
D. The Final Site Plan approval granted under this Order is specifically conditioned to the
requirement that the property owner, successor and assigns in interest, shall obtain all
necessary development permits and construction authorizations from the appropriate
State and Federal regulatory authorities including, but not limited to; the United States
Army Corps of Engineers, the Florida Department of Environmental Protection, and the
South Florida Water Management District, prior to the issuance of any local building
permits of authorizations to commence development activities on the property
. described in Part A.
E. This Order shall become effective upon the date of approval indicated below. Should
the property owner, developer or authorized agent wish to appeal any condition
described in Part A above, all such appeals must be filed in writing with the County
Administrator within 30 days of the rendering of this Order, as described in Section
11.02.03(6), St. Lucie County Land Development Code. Should an appeal to this
Order be filed, no permitting reviews or further administrative action shall take place on
the processing of this development project until the appeal is resolved.
F. A copy of this Order shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Planning and Development
Services Director and mailed to the applicant and agent of record as identified on the
site plan applications.
G. The conditions set forth in Part A are an integral nonseverable part of the site plan
approval granted by this Order. If any condition set forth in Section A is determined to
be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition, the site plan approval granted by this order shall become
null and void.

H. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as
this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
automatically terminate.
I. This order shall be recorded in the Public Records of St. Lucie County.
