4 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
5 ST. LUCIE COUNTY, FLORIDA, GRANTING PRELIMINARY/FINAL
6 PLANNED NON-RESIDENTIAL DEVELOPMENT SITE PLAN
7 APPROVAL WITH A CONDITIONAL USE FOR THE PROJECT TO BE
8 KNOWN AS THE AUTOZONE PNRD ON 1.19 ACRES OF LAND IN ST.
9 LUCIE COUNTY, FLORIDA

11 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based
12 on the testimony and evidence, including but not limited to the staff report, has made
13 the following determinations:

15 1. AUTOZONE STORES, INC. presented a petition for a Change in Zoning from
16 the CO (Commercial, Office) and RS-4 (Residential Single Family 4du/ac) to
17 the PNRD (Planned Non-Residential Development) Zoning District and
18 Preliminary/Final Planned Non-Residential Development Site Plan Approval
19 with a Conditional Use fora 7,381 square foot commercial retail sales store to
20 be known as The AutoZone PNRD for certain property in St. Lucie County,
21 Florida as depicted on the attached map as Exhibit "A" and described in Part
22 "B" below.

24 2. On January 19, 2012, the St. Lucie County Planning and Zoning Commission
25 held a public hearing on the petition after publishing a notice of such hearing
26 in the St. Lucie News Tribune and notifying by mail all property owners within
27 500 feet of the property boundaries at least 10 days prior to the hearing, and
28 recommended the Board of County Commissioners approve the subject
29 petition, for the property depicted on the attached map as Exhibit "A" and
30 described in Part "B" below.

32 3. On February 7, 2012, this Board held a public hearing on the petition of
33 AutoZone Stores Inc., for Preliminary/Final Planned Non-Residential
34 Development Site Plan Approval for the project known as The AutoZone
35 PNRD, after publishing a notice of such hearing in the St. Lucie News Tribune
36 and notifying by mail all property owners within 500 feet of the subject
37 property.

39 4. The Development Review Committee has reviewed the Planned Non-
40 Residential Development Preliminary/Final Site Plan with a Conditional Use
41 for the proposed project and found it to meet or exceed all technical
42 requirements and to be consistent with the Future Land Use maps of the St.
43 Lucie County Comprehensive Plan, subject to the .conditions set forth in Part
44 A of this Resolution.

5. The proposed project is consistent with the general purpose, goals, objectives
and standards of the St. Lucie County Land Development Code, the St. Lucie
County Comprehensive Plan, and the Code of Ordinances of St. Lucie
County.
6. This project provides benefits to the County by providing an infill development
providing for new retail and business opportunities in an area with adequate
public services and multi-modal transportation access in close proximity to
residents.
7. The proposed project will not have an undue adverse effect on adjacent
property, the character of the neighborhood, traffic conditions, parking, utility
facilities or other matters affecting the public health, safety and general
welfare.
8. All reasonable steps have been taken to minimize any adverse effect of the
proposed project on the immediate vicinity through building design, site
design, landscaping and screening.
9. The proposed project will be constructed, arranged and operated so as not to
interfere with the development and use of neighboring property, in accordance
with applicable district regulations.
10.The proposed project will be served potable water and wastewater services by
the City of Port St. Lucie Utilities.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
St. Lucie County, Florida:
A. Pursuant to Section 11.02.05(8) of the St. Lucie County Land Development Code,
the Planned Non-Residential Development Preliminary/Final Site Plan for the project
to be known as AutoZone PNRD is hereby approved as shown on the site plan
drawings for the project prepared by CPH Engineers, Inc. dated June 2011,
subsequently revised through October 28, 2011, and date stamped received by the
St. Lucie County Planning & Development Services Director on November 1, 2011,
subject to the following conditions:
1. Prior to issuance of a Vegetation Removal Permit or Exemption, the
applicant shall have obtained and provided the Environmental Resource:
Department with copies of any required federal and state permits. I
federal or state agency compliance requires modification to the
development plans, the applicant will promptly modify the plans anc
submit to St. Lucie County for review and approval as required by the
Land Development Code. The applicant will not use the County's

1 development approval to prevent compliance with any federal or state
2 agency requirements.

18 C. This Planned Non-Residential Development Preliminary/Final Site Plan
19 approval shall expire on February 7, 2014 unless an extension is granted in
20 accordance with Section 11.02.06(8)(3), St. Lucie County Land Development
21 Code, or a Major Adjustment to the Final PNRD Site Plan is granted.

23 D. Any modification to the approved PNRD Preliminary/Final Site Plan described
24 in Part A shall be in accordance with Section 11.02.05. Any adjustment that
25 is considered a Major Adjustment shall be granted only with approval by the
26 Board of County Commissioners after a public hearing.

28 E. The Preliminary/Final Planned Non-Residential Development Site Plan
29 approval granted under this Resolution is specifically conditioned to the
30 requirement that the petitioner, AutoZone Stores, Inc., including any
31 successors or assigns in interest, shall obtain all necessary development
32 permits and construction authorizations from the appropriate State and
33 Federal regulatory authorities, including but not limited to: the United Stated
34 Army Corp of Engineers, the Florida Department of Environmental Protection,
35 and the South Florida Water Management District, prior to the issuance of
36 any local building permits or authorizations to commence development
37 activities on the property described in Part B.

39 F. The conditions set forth in Part A are an integral non-severable part of the
40 site plan approval granted by this Resolution. If any condition set forth in Part
41 A is determined to be invalid or unenforceable for any reason and the
42 developer declines to comply voluntarily with that condition, the site plan
43 approval granted by this resolution shall become null and void.

G. A Certificate of Capacity, a copy of which is attached hereto and made a part
hereof the Resolution, was granted by the Planning & Development Services
Department Director on January 4, 2012.
H. The St. Lucie County Director of Planning & Development Services shall be
authorized to amend the Official Zoning Map to change the zoning of the parcel
herein described, from the CO (Commercial Office) and RS-4 (Residential Single
Family-4du/ac) Zoning Districts to the PNRD (Planned Non-Residential
Development) Zoning District, and to make notation of the reference to the date of
adoption of this resolution.
I. A recorded copy of this Resolution shall be attached to the site plan drawings
described in Part A, which plan shall be placed on file with the St. Lucie
County Planning & Development Services Department Director.
