3 A RESOLUTION OF THE BOARD OF COUNTY
4 COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA,
5 AUTHORIZING A CONSTRUCTION AGREEMENT WITH
6 THE STATE OF FLORIDA, DEPARTMENT OF
7 TRANSPORTATION FOR CONSTRUCTION,
8 INSTALLATION AND MAINTENANCE OF SIGN
9 IMPROVEMENTS WITHIN THE STATE RIGHT OF WAY;
10 DIRECTING THE APPROPRIATE TOWN OFFICIAL TO
11 EXECUTE THE AGREEMENT; PROVIDING FOR
12 REPEAL OF ANY CONFLICTING RESOLUTION;
13 SEVERABILITY; AND PROVIDING AN EFFECTIVE
14 DATE.

16 WHEREAS, the St. Lucie County (the "County") and the Treasure Coast Education,
17 Development and Research Authority (the "Authority") have proposed the construction of a
18 southbound right turn and deceleration lane within the Kings Highway (SR 713) right of way at
19 the intersection with Pruitt Research Road; and
20 WHEREAS, it is in the interest of St. Lucie County residents and visitors that this
21 additional lane be constructed, installed and maintained; and
22 WHEREAS, the County has reached an agreement with the State of Florida, Department
23 of Transportation ("the Department") for the construction, installation and maintenance of the
24 additionallane.
25 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
26 COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA:
27 Section 1. Recitals. Each "WHEREAS" clause set forth is true and correct, and
28 herein incorporated by this reference.
29 Section 2. Execution of Agreement. The Chairman, or Vice Chairman in the
30 absence of the Chairman, is hereby authorized to execute on behalf of the County the
31 Construction Agreement (the "Agreement") with the Department in the form attached hereto as
32 Exhibit "A" with such non-material changes as may be approved by the County Administrator
33 and the County Attorney, and such other documents necessary to implement the terms of the
34 Agreement.
35 Section 3. Authorized Individuals. The County Administrator and her designee and
36 the County Attorney are authorized to take all actions necessary to implement the terms of the
37 Agreement.
38 Section 4. Conflict. All resolutions or parts of resolution in conflict herewith are
39 hereby repealed to the extent of such conflict.
40 Section 5. Severability. If any clause, section or other part of this resolution shall
41 be held by any court of competent jurisdiction to be unconstitutional or invalid, such
42 unconstitutional or invalid part shall be considered as eliminated and in no way affecting the
43 validity of the other provisions of this resolution.
44 Section 6. Effective Date. This resolution shall become effective immediately upon
45 adoption.
