4 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY
5 AMENDING THE OFFICIAL ZONING ATLAS FORA 7.45 ACRE (M.O.L.) PARCEL OF LAND
6 OWNED BY FINE REALTY CORP FROM RMH-5 (RESIDENTIAL, MOBILE HOME - 5) TO
7 RVP (RECREATIONAL VEHICLE PARK).

9 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
10 testimony and evidence, including, but not limited to the staff report, has made the following
11 determinations:

13 1. Howard Fein, a representative of Fine Realty Corp, has filed a petition with St. Lucie
14 County to amend to the Official Zoning Atlas from RMH-5 (Residential, Mobile Home -
15 5) to RVP (Recreational Vehicle Park) fora 7.45 acre (more or less) parcel of land
16 located at 2601 N U.S. 1, Ft. Pierce, FL, 34946.

18 2. On February 16, 2012, the St. Lucie County Planning and Zoning Commission held a
19 public hearing on the petition, of which due notice was published in the St. Lucie News
20 Tribune and notifying by mail all owners of property within 500 feet of the subject
21 property, and recommended that the Board of County Commissioners approve the
22 change in zoning from RMH-5 (Residential, Mobile Home - 5) to RVP (Recreational
23 Vehicle Park).

25 3. On April 3, 2012, the Board of County Commissioners of St. Lucie County, Florida,
26 held a public hearing of which due notice was published in the St. Lucie News Tribune
27 and notifying by mail all owners of property within 500 feet of the subject property.

29 4. The proposed change in zoning has satisfied the requirements of Section 11.06.03 of
30 the St. Lucie County Land Development Code and is consistent with the goals,
31 objectives, and policies of the St. Lucie County Comprehensive Plan.

33 5. The proposed change in zoning is consistent with the existing and proposed use of
34 property in the surrounding area.

36 6. A Concurrency Deferral Affidavit, a copy which is attached to this Resolution, was
37 signed by the applicant on September 22, 2011.

39 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
40 County, Florida:

42 A. The proposed amendment to the Official Zoning Atlas from RMH-5 (Residential, Mobile
43 Home - 5) to RVP (Recreational Vehicle Park) for property depicted on the attached
44 map as Exhibit "A" and described below is approved.

Legal Description:
All that part of the North 358.8 feet of the South 1735.9 feet of the NE
1/4 lying West of U.S. Highway No. 1, Section 33, Township 34 South,
Range 40 East, St. Lucie County, Florida. AND Begin at the Southwest
corner of the portion of the North 365.8 feet of the South 1377.1 feet of
the Northeast quarter of Section 33, Township 34, South, Range 40
East, lying West of U.S. Highway No. 1, St. Lucie County, Florida.
From the point of beginning run North along the center line of Section
33 a distance of 365.8 feet to a point; thence run East along the North
line of the North 365.8 feet of the South 1377.1 feet of the Northeast
quarter of Section 33, Township 34 South, Range 40 East, a distance
of 400 feet to a point; thence run South a distance of 200 feet to a
point; thence run Southeasterly a distance of 193.77 feet to a point on
the South line of the North 365.8 feet of the South 1377.1 feet of the
Northeast quarter of Section 33, Township 34 South, Range 40 East,
which point is 483 feet East of the point of beginning and 200.29 feet
West of the West right of way line of new U.S. Highway No. 1; thence

B. The Planning and Development Services Director is hereby authorized and directed to
cause the change to be made on the Official Zoning Atlas of St. Lucie County, Florida,
and to make notation of reference to the date of adoption of this Resolution.
C. This Resolution shall take effect thirty-one (31) days after adoption. If the Resolution or
Ordinance No. 12-005 is challenged within thirty (30) days after adoption, the
Resolution shall not be effective until the State Land Planning Agency or
Administration Commission respectively issues a final order finding Ordinance No. 12-
005 in compliance in accordance with Section 163.3184(10) F.S.
D. A copy of this Resolution shall be mailed, return receipt requested, to the owner and
agent of record as identified on the application.
E. This Resolution shall be recorded in the Public Records.

elected to defer the certificate of capacity and reservation of capacity in public facilities for

I understand and acknowledge that the above listed property will be subject to the
certificate of capacity before any final development order can be issued, and that St.
Lucie County can make no guarantee that adequate public facilities will be available
when I apply for the final development order.
I further acknowledge that according to Section 5.08.01 of the St. Lucie County LDC, no
final development approval can be granted until capacity in those facilities is available at
that time. The issuance of a preliminary development order without a certificate of
capacity creates no vested or other rights to develop the subject property.
