LUCIE COUNTY, FLORIDA AMENDING RESOLUTION 94-222, GRANTING APPROVAL OF MAJOR ADJUSTMENT #1 TO THE FINAL PLANNED NONRESIDENTIAL DEVELOPMENT (PNRD) SITE PLAN FOR THE PROJECT KNOWN AS PGA VILLAGE GOLF CLUBHOUSE PNRD WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: PGA of America, Inc. has applied for a Major Adjustment to the existing Final Planned Non Residential Development (PNRD) Site Plan for the project known as the PGA Village Golf Clubhouse PNRD to provide for an expansion/renovation of the existing clubhouse facility, consistent with the previously approved non-residential square footages for the property described in Part B. 2. On November 1, 1994, this Board adopted Resolution 94-222, which granted Preliminary and Final Planned Non Residential Development approval for a change in zoning from AR-1 (Agricultural Residential, 1 du/ac) to PNRD (Planned Non- Residential Development) zoning fora 90,000 square foot golf clubhouse complex to service two previously approved and future golf courses associated with the Reserve DRI, which included a restaurant, pro shop, golf cart barn and other related accessory buildings. 3. On July 27, 2010, the Treasure Coast Regional Planning Council determined that the proposed Major Adjustment to the Final PNRD Site Plan for the PGA Golf Clubhouse PNRD does not contemplate any change that would create a reasonable likelihood of additional adverse regional impact, nor any other regional impact not previously reviewed by the Treasure Coast Regional Planning Council, and therefore does not constitute a substantial deviation from the conditions and requirements of the development order for the Reserve DRI, and has issued a letter of no objection to the County processing this change locally in accordance with Section 380.06(19)(e)2.k. Florida Statutes. 4. On May 1, 2012, this Board held a public hearing of which due public notice was published in the St. Lucie News Tribune, a sign was erected on the property, and a notice was mailed to all property owners within the entire Reserve DRI (Development of Regional Impact) at least 10 days prior to the hearing. At that public hearing the Agent for the applicant requested that the Board continue the public hearing for this item until May 15, 2012 at 9:00 am, or as soon thereafter as possible. JOSEPH E. On May 15, 2012, this Board reconvened the public hearing and considered the testimony, reports and other documentary evidence submitted at both public hearings by PGA of America, Inc., the Treasure Coast Regional Planning Council (TCRPC), St. Lucie County staff as well as the public and following that public hearing adopted Resolution 12-019, approving a Major Adjustment # 1 to the Final PNRD Site Plan for the PGA Village Golf Clubhouse PNRD to provide for an expansion/renovation of the existing clubhouse facility, consistent with the previously approved non-residential square footages. 6. Pursuant to Section 11.02.05(F), this Board has determined that approving this Major Adjustment to the Final PNRD Site Plan, for the project known as the PGA Village Golf Clubhouse PNRD, is not contrary to the public interest nor inconsistent with the health, safety, and welfare of the citizens of St. Lucie County and that the proposed Major Adjustment to the Final PNRD Site Plan for the PGA Village Golf Clubhouse is in substantial conformity with the original approval. 7. The proposed project is consistent with the general purpose, goals, objectives, and policies of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and with the general purpose and regulations set forth in the Code of Ordinances of St. Lucie County. 8. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 9. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 10. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 11. The proposed project will be served by adequate public facilities and services. 12. The applicant has applied for and received a Certificate of Capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. If federal or state agency compliance requires modification to the development plans, the applicant will modify the plans and submit to St. Lucie County for review and approval. The County's development approval process or requirements shall not be used to prevent compliance with any federal or state agency requirements. 2) Prior to issuance of a Certificate of Occupancy for any of the new structures, Category 1 invasive exotic vegetation shall be removed from the site. B. The approvals and authorizations granted by this Resolution for the purpose of obtaining building permits on this property, shall expire pursuant to Section 7.02.03(1) (2), and the final stage shall be completed within 10 years, or by May 15, 2022. Any extension of this date is subject to approval by the Board of County Commissioners unless otherwise amended by the Board of County Commissioners. The St. Lucie County Planning & Development Services Department Director shall be the local official assigned the responsibility for monitoring the development and enforcing the terms of the Development Order. The Planning & Development Services Department Director may require periodic reports of the developer with regard to any item set forth in this Development Order. E. This Major Adjustment to the Final PNRD Site Plan approval granted under this resolution shall be binding upon PGA of America, Inc., the developer and its assignees or successors in interest. It is understood that any reference herein to any governmental agency shall be construed to mean any future instrumentality which may be created and designated as successor in interest to, or which otherwise possesses any of the powers and duties of any referenced government agency in existence on the effective date of this amended Development Order. F. The approval granted by this Major Adjustment to the Final PNRD Site Plan is conditional and shall not be construed to obviate the duty of the developer to comply with all other applicable local, State, and federal permitting requirements. G. In the event that any portion or section of this Major Adjustment to the Final PNRD Site Plan is deemed to be invalid, illegal, or unconstitutional by a court of competent jurisdiction, such decision shall in no manner affect the remaining portions or sections of this amended Development Order, which shall remain in full force and effect. H. A copy of this resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. The certificate of capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. J. This Major Adjustment to the Final PNRD Site Plan approval shall become effective upon adoption. K. This Order shall be recorded in the Public Records of St. Lucie County.
