Adj. to Minor Site PlanPDS NO. 12-023 File No.: SPMj 1220114372 AN ORDER GRANTING APPROVAL FOR A MAJOR ADJUSTMENT TO A MINOR SITE PLAN TO BE KNOWN AS HARBOR COMMUNITY BANK -PRIMA VISTA. WHEREAS, the St. Lucie County Planning and Development Services Department has reviewed the application for a Major Adjustment to a Minor Site Plan submitted by Harbor Community Bank -Prima Vista and the comments from the St. Lucie County Development Review Committee on this application and made the following determinations: 1. Harbor Community Bank -Prima Vista consists of a 2,885 square foot drive- through facility on 0.64 acres of property in the CG (Commercial, General) Zoning District, located at Prima Vista Crossing, '/4 mile north of Prima Vista Boulevard on the east side of US Highway No. 1. 2. On February 22, 2012 the Board of Adjustment approved a Variance from the provisions of Sections 7.06.02.B.1.j. and 7.09.04.6.1. of the St. Lucie County Land Development Code to allow a 1.5 foot reduction in width for the drive- through queuing areas, and a 4 foot reduction in width for the landscape buffer adjacent to vehicular storage area that is located along the north property line. 3. On March 26, 2003 the Growth Management Director approved a Minor Site Plan fora 3,260 square foot Wendy's fast food restaurant via CD Order No. 03-005 on the same property described in Paragraph B. 4. The Development Review Committee has reviewed the site plan adjustment for the proposed project and found it to meet the technical requirements of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 5. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. 8. The project is to be served by the City of Port St. Lucie Utilities water and wastewater services. 9. The applicant has applied for and received a Certificate of Capacity, a copy which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Major Adjustment to the Minor Site Plan known as Harbor Community Bank - Prima Vista is hereby approved as shown on the site plan drawings prepared by MBV Engineering, Inc., dated April 2, 2012 and date stamped received by the St. Lucie County Planning and Development Services Department on May 21, 2012, subject to the following conditions: 1. Prior to the issuance of a Building Permit, the applicant shall obtain the required permits and execute any applicable water and wastewater utility agreements with the City of Port St. Lucie Utilities. 2. Prior to issuance of the Certificate of Occupancy, the applicant shall coordinate with Environmental Resources Department staff regarding required materials for the landscape buffer areas. The existing landscape buffers contain some acceptable hedge material. 3. Prior to issuance of a Vegetation Removal Permit or Exemption, copies of any required federal and state permits and approvals, if applicable to development, shall be provided to the Environmental Resources Department. If federal or state agency compliance requires modification to the development plans, the applicant will modify the plans and submit to St. Lucie County for review and approval. The County's development approval process or requirements shall not be used to prevent compliance with any federal or state agency requirements. 6. The property on which this Major Adjustment to the Minor Site Plan approval is being granted is described as follows: ALL OF LOT 1, OF THE PLAT ENTITLED PRIMA VISTA CROSSINGS REPEAT NO. 1, AS RECORDED IN PLAT BOOK 41, PAGE 31, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. '~, May 25, 2012 File No.: SPMj 1220114372 Page 2 PDS Order No.12-023 AND TOGETHER WITH NON-EXCLUSIVE EASEMENTS FOR ACCESS, PARKING, UTILITIES, AND DRAINAG, AS SET FORTH IN AND GRANTED IN DECLARATION OF EASEMENTS AND RESTRICTIVE COVENANTS RECORDED IN MAY 16, 2003 IN OFFICIAL RECORDS BOOK 1714, PAGE 1207. AND TOGETHER WITH CROSS PARKING EASEMENTS OVER LOT 2, PRIMA VISTA CROSSINGS REPEAT NO. 1, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 41, PAGE 31, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, FOR USE OF ALL PARKING AND ACCESS DRIVES, AS SET FORTH ON AND GRANTED BY THE DEDICATION F SAID PLAT. LOT 2, PRIMA VISTA CROSSINGS REPEAT NO. 1, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 41, PAGE 31 PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Parcel Identification Number: 3422-856-0002-000-8. C. The approvals granted by this administrative order shall expire May 25, 2013, unless an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The Site Plan approval granted under this Order is specifically conditioned to the requirement that the property owners, successors and assigns in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits or authorizations to commence development activities on the property described in Part B. E. This Order shall become effective upon the date of approval indicated below. Should an aggrieved party request to appeal any condition described in Part A above, all such appeals must be filed in writing with the Planning and Development Services Director in accordance with the provisions of Section 11.11.01(8)(3). Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning and Development Services Director and mailed, return receipt requested, to the developer and agent of record as identified on the site plan application. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. H. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or othenivise terminates, the Certificate of Capacity shall automatically terminate. This order shall be recorded in the Public Records of St. Lucie County. Certificate Expiration Date The certificate of capacity shall be valid for the same period of time as the Development Order. Section 5.08.04(B), St. Lucie County Land Development Code.
