Drawdy Subdivision consists of two (2) single family lots totaling 20.01 acres of property in the AG-5 (Agricultural -5) Zoning District, located on the south side of Germany Canal Road, '/4 mile west of Carlton Road.as described in Part B below. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Pan. 3. The original 20 acre tract was created by an agricultural lot split that did not require platting. The division of this parcel results in the creation of two (2) lots which are required to be platted after a site plan is approved. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. 7. The applicant has applied for and received a Certificate of Capacity, a copy which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Minor Site Plan known as Drawdy Subdivision is hereby approved as shown on the site File No.: MNSP 420124435 PDS Order No. 12-024 June 22, 2012 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 plan drawings for the project prepared by Culpepper and Terpening, Inc., dated February 10, 2012 and date stamped received by the St. Lucie County Planning and Development Services Department on June 14, 2012, subject to the following condition: 1. Prior to issuance of a Vegetation Removal Permit or Exemption, copies of any required federal and state permits and approvals, if applicable to development, shall be provided to the Environmental Resources Department. If federal or state agency compliance requires modification to the development plans, the applicant will modify the plans and submit to St. Lucie County for review and approval. The County's development approval process or requirements shall not be used to prevent compliance with any federal or state agency requirements. B. The property on which this Minor Site Plan approval is being granted is described as follows: THE SOUTH '/2 OF THE SOUTHEAST '/4 OF SECTION 20, TOWNSHIP 36 SOUTH, RANGE 38 EAST, LESS ROAD RIGHT-OF-WAY AS IN OFFICIAL RECORDS BOOK 175, PAGE 421 AND LESS THE SOUTH 633.28 FEET AND LESS THE EAST 1267.53 FEET. PARCEL I D# 3220-431-0001-000/6 C. The approvals granted by this administrative order shall expire June 22, 2014, unless an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code or final plat has been recorded in St. Lucie County Public Records. D. The Final Site Plan approval granted under this Order is specifically conditioned to the requirement that the property owners, successors and assigns in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, North St. Lucie Water Control District and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the Planning and Development Services Department within 30 days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. G. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth is Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. H. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. This order shall be recorded in the Public Records of St. Lucie County.
