HomeMy WebLinkAboutPDS-12-025 - Spanish Lakes One1 PDS-12-025 2 SPMn 420124436 3 4 AN ORDER OF THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR 5 GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO THE MAJOR SITE 6 PLAN KNOWN AS SPANISH LAKES ONE ON CERTAIN PROPERTY 7 SITUATED IN ST. LUCIE COUNTY, FLORIDA. 8 9 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the to application for a Minor Adjustment to the Major Site Plan submitted by Culpepper and 11 Terpening, Inc. on behalf of Wynne Building Corporation and reviewed the comments of the 12 Development Review Committee on this application and made the following determinations: 13 14 1. Wynne Building Corporation presented a petition for a Minor Adjustment to the Major 15 Site Plan known as Spanish Lakes One submitted by Culpepper and Terpening, Inc. for 16 property generally located on the east side of US Highway No. 1, approximately'/2 mile 17 south of Prima Vista Boulevard on +/-280.8 acres, consisting of the following changes: 18 19 Modifications to the building setbacks/separations to allow forthe construction of 2 o conventionally built homes which are approximately 6.4% larger in size than the 21 typical mobile home constructed on home sites throughout the development; and 22 23 To include conventionally built homes as a proposed use in the site data table, in 24 addition to mobile homes. 25 2 6 2. The Development Review Committee reviewed the Minor Adjustment to the Major Site 27 Plan and found it to meet technical requirements of the Land Development Code and to 28 be consistent with the St. Lucie County Comprehensive Plan. 29 30 3. The proposed Minor Adjustment to the Major Site Plan is consistent with the general 31 purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan 32 and the St. Lucie County Land Development Code. 33 34 4. The proposed modifications will not have an undue adverse effect on adjacent property, 35 the character of the neighborhood, traffic conditions, parking, utility facilities, or other 36 matters affecting the public health, safety, and general welfare. 37 38 NOW, THEREFORE, BE IT ORDERED: 39 4 o A. Pursuant to Section 11.02.04 (C) of the St. Lucie County Land Development Code, the 4 1 Minor Adjustment to the Major Site Plan for the project known as Spanish Lakes One 4 2 is hereby approved as shown on the site plan dated April 13, 2012, prepared by 43 Culpepper and Terpening, Inc. and date stamped received by the St. Lucie County 4 4 Planning and Development Services Department on June 14, 2012, subject to the 45 following conditions: 46 47 File No.: SPMn 420124436 June 22, 2012 JOSEPH E. SMITH, CLERK OF THE CIRCUIT COURT PDSPage 1 SAINT LUCIE COUNTY FILE # 3721703 07/05/2012 at 11:21 AM OR BOOK 3407 PAGE 875 - 879 Doc Type: ORD RECORDING: $44.00 Residential Units to 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 96 47 48 Prior to the issuance of any Certificate of Occupancy for any individual residential unit in the Spanish Lakes One community, all Category 1 invasive vegetation, as defined by the Florida Exotic Pest Council's (FLEPPC) 2011 List of Invasive Plant Species, shall be removed from the individual building site and all required lot landscaping for that unit will be installed in accordance with the County's approved species (excluding queen and Washingtonia palms). For the purpose of this condition an individual palm shall be considered to equal one "tree" for all replacement and new plantings. Regardless of the lot size in Spanish Lakes One, the minimum number of trees shall be three (3). Common Areas The definition of Common Area Landscaping in Spanish Lakes One shall be delineated as the area from the entrance of the property at U.S. Highway One and Mediterranean Blvd North (traffic light) east to the intersection of Mediterranean Blvd North and Mediterranean Blvd West, the entrance of the property at U.S. Highway One and Mediterranean Blvd South east to the intersection of Mediterranean Blvd South and Mediterranean Blvd West (Alhambra), the entire clubhouse and surrounding recreation area, including all parking lots. Also included are all the cul-de-sacs and the strip of land that is between the edge of pavement and a lake that is not considered a home site. In the common areas, the developer shall remove all Category I Invasive Plant Species (as defined by FLEPPC). For every Category I (excluding queen and Washingtonia palms) Invasive Plant Species removed, we will replace it with one that is in accordance with the County's approved species. All common area landscaping will be completed within three years from the date of the approved minor site plan amendment. The applicant shall contact the Environmental Resources Department for an inspection once work has been completed. B. The property on which this Minor Adjustment to the Major Site Plan is being granted is described as follows: Legal Description: Being a parcel of land lying in Section 26, Township 36 South, Range 40 East, St. Lucie County, Florida, being more particularly described as follows; Begin at the Northwest corner of said Section 26; thence North 89 degrees 52 minutes 05 seconds East along the North line of Section 26, a distance of 2,639.20 feet to the North %4 of Section 26; thence North 89 degrees 57 minutes 44 seconds East a distance of 2,647.39 feet to the Northeast corner of Section 26; thence South 00 degrees 17 minutes 57 seconds East, along the East line of Section 26, a distance of 2,650.10 feet to the East'/4 corner of Section 26; thence South 89 degrees 56 minutes 02 seconds West a distance of 4,106.37 feet to the Easterly right-of-way line of U.S. Highway No. 1, a 200.00 foot right-of-way, thence North 27 degrees 56 minutes 07 seconds West, along said Easterly right-of-way line, a distance of 2,544.10 feet to the West line of Section 26; File No.: SPMn 420124436 PDS-12-025 June 22, 2012 Page 2 then North 00 degrees 19 minutes 01 seconds West, along the West line of said Section 26, a distance of 399.32 feet to the POINT OF BEGINNING. The Minor Adjustment approval granted underthis order is specifically conditioned to the requirement that the petitioner, Wynne Building Corporation, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to: the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. D. The conditions set forth in Part A are an integral nonseverable part of the minor adjustment approval granted by this development order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this development order shall become null and void. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning and Development Services Director and copies provided to the developer and authorized agent as identified on the site plan application. F. This order shall be recorded in the Public Records of St. Lucie County and a copy of the order shall be mailed, return receipt requested to the property owner, and authorized agent as identified on the site plan application.
