AN ORDER GRANTING APPROVAL FOR A
MINOR SITE PLAN TO BE KNOWN AS
AMERICAN LEGION POST #318
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed
the application for Minor Site Plan approval submitted by American Legion Post #318, and the
comments of the St. Lucie County Development Review Committee on this application, and
made the following determinations:
American Legion Post #318 consists of a 6,300 s.f. social hall with a 144 s.f. outdoor
covered bar area, on a 2.183 acre parcel in the CG (Commercial-General) Zoning
District, located on Savanna Club Boulevard, situate in St. Lucie County, Florida as
described in Part B below.
2. The Development Review Committee has reviewed the site plan for the proposed project
and found it to meet technical requirements in Section 11.02.07 of the St. Lucie County
Land Development Code and to be consistent with the St. Lucie County Comprehensive
Plan.
3. The project will not have an undue adverse effect on adjacent property, the character of
the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting
the public health, safety, and general welfare.
4. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
5. The project will be constructed, arranged, and operated so as not to interfere with the
development and use of neighboring property, in accordance with St. Lucie County Land
Development Code requirements.
6. The project is to be served by the Port St. Lucie Utilities System Department for water
and wastewater services.
7. The applicant has applied for and received a Certificate of Capacity, a copy which is
attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land
Development Code.

NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the
Minor Site Plan known as American Legion Post #318 is hereby approved as shown
on the site plan drawings for the project prepared by Friscia Engineering, dated March 8,
2011 and revised through June 28, 2012, and date stamped received by the St. Lucie
County Planning and Development Services Department on July 6, 2012, subject to the
following conditions:
1. Prior to the issuance of any building permit, the applicant shall obtain the required
permits and execute any applicable water and wastewater utility agreements with the
Port St. Lucie Utilities System Department.
2. Prior to issuance of a Vegetation Removal Permit or Exemption, apre-construction
meeting with ERD staff shall be conducted to verify tree protection measures have
been put in place. If improper methods result in the death of any tree proposed for
preservation mitigation at a ratio of 2:1 shall be required.
3. Shall the applicant choose to construct a sign, landscaping requirements will be
consistent with Land Development Code 9.02.01.D.
4. The property owner, it's successor and assigns, shall obtain and provide to the
Environmental Resources Department copies of any federal and state
permits/authorizations (or notices of intent to issue same) prior to issuance of a
Vegetation Removal Permit or Exemption. The preceding shall not preclude or delay
the issuance of local building permits or authorizations for development activities that
are not dependent on the prior issuance of state or federal permits or authorizations,
or notices of intent to issue same. If federal or state agency compliance requires
modification to the development plans, the applicant will promptly modify the plans
and submit to St. Lucie County for review and approval as required by the Land
Development Code. The applicant will not use the County's development approval
to prevent compliance with any federal or state agency requirements.
B. The property on which this Minor Site Plan approval is being granted is described as
follows:
LOT 2, SAVANNA PLAT #18, ACCORDING TO THE PLAT THEREOF, AS
RECORDED IN PLAT BOOK 63, AT PAGE 18, OF THE PUBLIC RECORDS OF
ST. LUCIE COUNTY, FLORIDA.

C. The approvals granted by this administrative order shall expire July 6, 2014, unless an
extension is granted in accordance with the provisions of Section 11.02.06 of the St.
Lucie County Land Development Code.
D. The Minor Final Site Plan approval granted under this Order is specifically conditioned to
the requirement that the property owners, successors and assigns in interest, shall
obtain all necessary development permits and construction authorizations from the
appropriate State and Federal regulatory authorities including, but not limited to, the
United States Army Corps of Engineers, the Florida Department of Environmental
Protection, North St. Lucie Water Control District and the South Florida Water
Management District, prior to the issuance of any local building permits of authorizations
to commence development activities on the property described in Part A.
E. This Order shall become effective upon the date of approval indicated below. Should
the property owner, developer or authorized agent wish to appeal any condition
described in Part A above, all such appeals must be filed in writing with the Planning &
Development Services Department within 30 days of the rendering of this Order, as
described in Section 11.02.03(6), St. Lucie County Land Development Code. Should an
appeal to this Order be filed, no permitting reviews or further administrative action shall
take place on the processing of this development project until the appeal is resolved.
F. A copy of this Order shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Planning and Development
Services Director and mailed, return receipt requested, to the developer and agent of
record as identified on the site plan application.
G. The conditions set forth in Part A are an integral non-severable part of the site plan
approval granted by this Order. If any condition set forth is Section A is determined to
be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition, the site plan approval granted by this order shall become
null and void.
H. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as
this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
automatically terminate.
This order shall be recorded in the Public Records of St. Lucie County.
