AN ORDER GRANTING AN ADMINISTRATIVE RELIEF FOR
CERTAIN PROPERTY LOCATED AT 6251 N. US Hwy #1
SITUATE IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Planning and Development Services Director of St. Lucie County, Florida,
based on the written request and staff report, has made the following determinations:
Wallace Tavlor. III petitioned for an administrative relief from the provisions of Section
7.06.02 of the St. Lucie County Land Development Code to allow for the reduction of
three parking spaces from the eight parking spaces required for the retail sales of
outdoor products business to be located at 6251 N. US 1.
2. The property owner was granted a lease area (2,322 sq. ft.) by Florida Department of
Transportation with in the North US 1 Hwy right-of-way. This lease area granted by FDOT
can only accommodate four parking spaces. The applicant will provide three standard
parking spaces and one handicap parking space in this area. Another parking space will be
located on the property adjacent to an existing driveway on the north side of the property for
a total of five parking spaces.
3. After review of the analysis, including staff comments, exhibits, and the standards of
review for granting administrative relief set out in Section 10.01.02, St. Lucie County
Land Development Code, the Planning and Development Services Director has made
the following determinations:
The requested administrative relief has met the standards of review as set forth in
Section 10.01.02, St. Lucie County Land Development Code, and is not in conflict with
the goals, objectives, and policies of the St. Lucie County Comprehensive Plan,
because:
A. The granting of the requested administrative relief arises from conditions that are
unique and peculiar to the land and building involved and the particular physical
surroundings and topographical condition of the specific property involved that would
result in unnecessary hardship to the owner if the provisions of this Code are literally
enforced;
8. The granting of the requested administrative relief would not impair or otherwise
injure adjacent property owners or improvements in the area in which the subject
property is located;
C. The granting of the requested administrative relief allows for the sales of outdoor
products business to operate at 6251 N US 1 with 5 parking spaces, the proposed
administrative relief is the minimum needed to make possible the reasonable use of
the land and existing building;
D. The requested variance meets the general spirit and intent of the St. Lucie County
Land Development Code and the St. Lucie County Comprehensive Plan.
