HomeMy WebLinkAboutPDS-12-034 - Golden Nugget Arcade1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 PDS 12-034 SPMN 520124440 AN ORDER GRANTING APPROVAL FOR A MINOR SITE PLAN KNOWN AS GOLDEN NUGGET ARCADE WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for Minor Site Plan approval submitted by Adobe Corporation, and the comments of the St. Lucie County Development Review Committee on this application and made the following determinations. 1. Adobe Corporation requested a Minor Site Plan to allow fora 1,422 s.f. addition to an existing 5,452 s.f. building and provide for additional required off-site landscaping and parking improvements in accordance with Section 7.06.02.8.2 of the St. Lucie County Land Development Code. The subject 0.87 acre shopping center out-parcel is zoned CG (Commercial General) and is located at 7181 U.S. Highway No. 1 as described in Part B below. 2. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida adopted Ordinance No. 12-003 allowing authority to grant administrative relief to certain land development code regulations provided that the overall project meets the intent of the Land Development Code. The following administrative relief provisions are granted in this minor site plan approval: a. The Environmental Resources Director has granted afive-foot reduction in the required ten-foot wide terminal landscape parking island located on the east side of the building per Section 7.09.04.C and afive-foot reduction in the required ten-foot wide perimeter landscape buffer along the south and west property lines per Section 7.09.04.6. b. The Planning and Development Services Director has authorized the use of 34 parking stalls on an off-site vacant lot owned by the applicant located at 7180 U.S. Highway to meet the required amount of parking for the use. 3. The Development Review Committee reviewed the site plan for the proposed project and found it to meet the technical requirements of the St. Luce County Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan subject to the alternative development standards identified above. The project will not have an undue adverse effect on adjacent property, the 2 character of the neighborhood, traffic conditions, parking, utility facilities, or 3 other matters affecting the public health, safety and general welfare. 4 5 5. All reasonable steps have been taken to minimize any adverse effect of the 6 proposed project on the immediate vicinity through building design, site 7 design, landscaping and screening. 8 9 6. The project will be constructed, arranged, and operated so as not to interfere 10 with the development and use of neighboring property, in accordance with St. 11 Lucie County Land Development Code requirements. 12 13 7. The project is to be served by Port St. Lucie Utilities water and wastewater 14 services. 15 16 8. The applicant has applied for and received a Certificate of Capacity, a copy 17 which is attached to this order as Exhibit A, as required under Chapter V, St. 18 Lucie County Land Development Code. 19 20 NOW, THEREFORE, BE IT ORDERED: 21 22 A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development 23 Code, the Minor Site Plan known as Golden Nugget Arcade is hereby 24 approved as shown on the plan drawings for the project prepared by Land 25 Design South dated August 31, 2012 and date stamped received by the St. 26 Lucie County Planning and Development Services Department on September 27 17, 2012 on the property described in Part B, subject to the following 28 conditions: 29 30 1. Prior to issuance of a Vegetation Removal Permit or Exemption, apre- 31 construction meeting with Environmental Resources Department staff 32 shall be conducted to verify tree protection measures have been put in 33 place. If improper methods result in the death of any tree proposed for 34 preservation, mitigation at a ratio of 4:1 shall be required. 35 36 2. Prior to the issuance of a Certificate of Occupancy, all landscaping 37 improvements to the off-site parking lot located at 7180 US Highway 38 No. 1 shall be completed. The parking lot shall be maintained free of 39 any potholes and debris, and the parking stalls shall be striped. 40 41 3. The County's issuance of development approval does not constitute 42 compliance with any federal and state requirements. Applicable 43 federal and state permits/approvals are required prior to the File Number: 520124440 PDS Order 12-034 September 26, 2012 Page 2 1 commencement of any development activity (i.e. clearing, grading, 2 removing structures, etc.). The responsibility for contacting federal and 3 state agencies, procuring permits/approvals and compliance with 4 applicable laws are the sole responsibility of the property owner. 5 6 4. Per Florida Statute 125.022, the issuance of development approval 7 does not create any liability on the part of the County if the applicant 8 fails to obtain requisite approvals or fulfill the obligations imposed by a 9 state or federal agency or undertakes actions that result in a violation 10 of state or federal law. 11 12 5. Prior to the issuance of a Vegetation Removal Permit and any 13 development activity, copies of all applicable state or federal 14 permits/written approvals are required to be submitted to the 15 Environmental Resources Department. 16 17 B. The approvals granted by this administrative order shall expire on September 26, 2014 unless an extension is granted or a building permit is secured in accordance with the provisions of Section 11.02.06 of the St. Lucie Land Development Code. E. The Minor Site Plan approval granted under this administrative order is specifically conditioned to the requirement that the property owners, successors and assigns in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. F. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing to the Board of Adjustment within 30 days of the rendering of this Order, as described in Section 11.02.03.8, St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. G. A copy of this Order shall be attached to the site plan drawings described in Part A, which shall be placed on file with the St. Lucie County Planning and Development Services Director and mailed, return receipt requested, to the developer and agent of record as identified on the site plan application. H. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this Order. If this Order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. J. This Order shall be recorded in the Public Records of St. Lucie County.
